AN ORDINANCE declaring the need for the condemnation oi' certain real
property in Kitsap County, State of Washington, for 'bhe purpose of securing a
supply of gravel, directing condemnation of the said property and payment of
just compensation therefor, and declaring an emergency.
THE CITY OF BREIviERTON ~ES 0F~DAIN:
S~tion 1. That it is necessary that the City of Bremerton acquire pro-
petty situated in Kitsap County, Washington, ~'or the purpose of securing there-
from gravel for the needs oI~ the City an~ that to accomplish said purpose it
is necessary for the City to acquire the fee simple title in and to the follow-
ing lands, in Kitsap County, State of Washington:
Parcel (a): Lot 1; EXCEPT the west ~ I'eet; EXCEPT the North 10 feet
and EXCEPT the east 10 feet; and Lots ~ to 1~, 'both inclusive; EXCEPT
the west $ feet and EXCEPT the east 10 feet; ALL in Block ~, Liebly &
Blumer~s First Addition to Bremerton Heights, according to plat there-
of recorded in Volume ~ of Plats, Page 8~, records of said County.
Parcel (b): Lot 15, EXCEPT the west ~ I~eet and EXCEPT the east 10 feet
Block ~, Liebly & Bl~ner's First Addition to Bremerton Heights~ accord-
ing to plat thereof recor¢~ed in Volume ~ of Plats, Page 89, records of
sai~ County.
Parcel (d): Lot ~Z; EXCEPT the east ~ feet; EXCEPT th~ south 10 feet
and EXCEPT the west 10 feet; and
Lots ~ to °~6, both inclusive; EXCEPT the east ~ feet and
EXCEPT the west 10 feet; ALL in Block Z, Liebly & Blumer's First Add-
ition to Bremerton Heights, according to Plat thereof recorded in Vol-
ume ~ of Plats, Page 89, records oI~ saim County.
Parcel (e): Lots ~7 to 41, both inclusive; EXCEPT the east ~ feet
and EXCEPT the west 10 feet;
Lot 42; EXCEPT the east 3 feet; EXCEPT the north 10 feet
and EXCEPT the west 10 feet; ALL in block 2, Liebly & Bl~er's First
Addition to Bremerton Heights, according to Plat thereof recorded in
Volume 3 of Plats, Page 89, records oi' said County.
Parcel (f): The west 3 feet and east 10 feet of Lots i to 21, .both
inclusive; The north 10 feet of said Lot 1; The south 10 feet o~' said
Lot 21; The east 3 foet and west 10 feet of Lots 22 to 42, both in-
clusive; The south 10 feet of said Lot ~; and the north 10 feet of
said Lot 42; ALL in Block 2, Liebly & Blumer~s First Addition to Brem-
erton Heights, according to'plat thereof recorded in Volume 3 oi' Plats,
page 89, records of said Cotmty.
That the City Clerk and Purchasing Agent has been authorized ariel directed
to purchase saia real property upon direct negotiation with the owners thereof
but i-t is essential that the City obtain title to said property without delay
and certain oI~ the owners 6f some cz~ the lands described have brought a~ action
~or d~nages against the City anm it now appears desirable to institute condem-
nation proceemings for the purpose of determining the just compensation to be
paid the owners thereof.
Section 2. The City Attorney is hereby authorized and directed to pro-
ceed immediately with the condemnation of said real property in the Superior
Court of the State of Washington for Kitsap County.
Section 3. An emergency exists and this orminance is necessary for the
imm~emiate preservation of public peace, healt~ and safety in 'the City of Brem-
erton and for the purpose o: ge~eral welfare the stone shall taXe effect immed-
iately following passage and publication.
PASSED and approved unanimously by the City Council oi' the C~ty of Brem-
erton, signed by the Mayor and attested by the City Clerk in authentication of
such passage this 28th ~ay of December,
