AN ORDINANCE providing for the creation and establishment or a special
fund to be known as "North Perry Avenue Water District Reserve Fund" and
providing for the deposit of funds therein not to exceed the sum of $10,O00.

THE CITY OF BR~-ERTON DOES ORDAIN:
Section 1. Whereas, by a certain contract in writing denominated "Agree-
ment for Supplying Water" made the 30th day of November, 1949, by and between
the City of Bremerton and North Perry Avenue Water District, a municipal cor-
poration, it was agreed that there would be established by the City of Brem-
erton a special fund in the amount of $10,000.00 as a reserve fun~ to be
accumulated from a collection of $1.00 per month from consumers in L.I.D. No.
2 oi' said North Perry Avenue Water District, and which agreement further pro-
vided that the fund was for the purpose of repairing and replacing wooden
mains serving L.I.D. No. P. and which agreement provided for payment into said
fund and disbursements therefrom and also provided for a final disposition of
said fund, and it being necessary that said fund be created an~ established
by ordinance.
Now, therefore, there is hereby established in the Treasurer,s Office
in the City of Bremerton a special fun~ to be known as the "North Perry
Avenue Water District Reserve Fund", and the Treasurer of the City of Brem-
erton is hereby authorized an~ directe~ to receive from the Treasurer of Kit-
sap County, Washington, all payments made by said Treasurer o£ Kitsap County,
Washington, received from consumers in L.I.D. No. 2 of North Perry Water Dis-
trict and to hold the same in said special fund until the sum of $10,000.00
has been accumulated, and thereaI'ter no further payments shall be made in the
said North Perry Avenue Water District Reserve Fund.
Section 2. During the time said North Perry Avenue Water District Re-
serve Fund is maintained, and any repair or replacement of the wooden mains
is made necessary, the Superintendent of the Water Department of the City of
Bremerton shall notify the Treasurer in writing of the need for such expend-
iture an~ the Treasurer shall thereafter forward a copy of saidnotice to
North Perry Avenue ~ater District an~ after an elapse o~' fifteen (lC) days
from the mailing ~f said notice if no objection is made by the North Perry
Avenue Water District disbursement of the necessary funds shall be made by
the City Treasurer of Bremerton. In the event that any repair or replacement
of mains is made by North Perry Avenue Water District directly, notice of
such intention shall be given to the Treasurer of the City of Bremerton and
after fifteen (15) days from the date oi' such notice the City Treasurer may
pay to North Perry Avenue Water District the amount necessary to pay for such
replacement or repair.
Section 3. Should the City of Bremerton or North Perry Avenue Water.
District make other arrangements i'or the transportation of water to L.I.D.
No. 2, making the use of the wooden mains unnecessary, the North Perry Ave-
nue Water District Reserve Fund shall no longer be maintained, and upon not-
ice to the City Treasurer of such fact by the North Perry Avenue Water Dis-
trict an~ by the Superintendent of the ~'¥ater Department of the City of Brem-
erton, the funds shall no longer be maintained and the Treasurer is authorized
to pay to North ~ Perry Avenue Water District, a municipal corporation, the bal-
ance of said funds then remaining in the North Perry Avenue Water District
serve Fund,
