AN ORDINANCE providing for the improvement of' Ta~'t Avenue from a point
15 feet north oz' the south margin o~~ ~Oth Street to a point ~3~ feet north
of said south margin of 2otb ~treet by the construction of sanitary sewers,
such sewer not including basemen~ drainage, all in accordance with the plans
maps and specifications now on i~ile in the office ol~ the City Clefs estab-
lishing an improvement district, providing for the levying of assessments
for the payment of such improvement and maXing such improvement payable by
~onds.
THE CITZ OF BRE~RTON ~ES ORDAIN:
Section 1. ~at Taft Avenue from a point l~ feet no,th oz' the south
margin o!' ~O~h Street ~ a point ~Z~ feet north o~' said south margin of ~Oth
be improved by the construction oI' sanitary sewers, such sewer noo includ-
ing basement drainage, together with ohe doing oI' any and all other work in
connection therewith as may be necessary to maxe such improvement a complete
Job, all in accordance with the maps, plans ~d speciz'ica~ions now on ~ile
in the office of the City Clerk of ~he City of Bremerton.
Section ~. ~at the cost and expense o~' said improvement shall be borne
by ~d assessed against the property included in the assessment district here
inafter created, in accordance with the provisions of Section ~OS of Reming-
ton's Revised Statutes, except such proportion oi' said cost as shall be borne
by and paid for by the State of Was~ington or other gover~ental agency,
which proportion oI' such cost and expense is hereby declared to be in accord-
ance with the special 0enefits conI'erred upon such property.
Section ~. That ~here is hereby established ~d created a local im-
provement district ~o be called and known as "Local Improvement District No.
~'~, the 0o~daries of which are described as follows: Begl~ing at a point
~8.~8 feet South and $00 X'eet East of the ~ corner of the SW~ o~' the SW~~ of
Sec. ll, T ~ N, R i E, WI~.; th E ~0 z~eet, th S on a line parallel ~to the
cen~erline oi~ Tal't Avenue ~88 feet; th W ~0 feet to the west ~margin of Taft
Avenue; th N along said west margin 79 feet; th W l~0 feet; th~N on a line
parallel to the cen~erline oX~ Taxer Avenue ~8~ feet to Ohe poino oI~ 0eginning.
Section ~. That the cost and expense of said improvement to be borne
by said improvement district and exclusive of any portion borne by either
the State of Washington or other gover~ental agency shall 0e assessed agains
said property included in said improve~ent district in proportion to said
~ea, except certain ~its wherein the special 0enefiOs ~nferred upon the
property are not fairly reflected by the use of the ~er~ini and ~ne method,
the assessment shall oe made again~t theproper~y o~' ~he district in accord-
~ce with the special beneI~its it will derive I'rom the improvement without
~egard to the zone and ~e~ini me~hod, and in accordance with the provisions
ot' Section 9Z8~ of Remington's Revised S~atutes oI' ~the S~ate of Washington
an~ Ohe remainder o~~ said cost of the improvement to ~ paid for 0y arrange-
ment, ii' ~y, with the S~ate oI' Washington or other gover~ental agency.
Section ~. That bonds bearing interest at the rate o~' not to exceed
six percent per ann~, payable on or oefore ten years from the date oI~ issu-
~ce, shall be issued in pa~ent oI' ~he ~s~ and expense oI' said improvement
assessed against the property included in the district hereinabove describ-
ed, which bonds s~akl 0e redeemed by a collection oI~ special assessments
levied and assessed against ~he property within sai~ district, payable in
eight equal annual installments, wit~ interest at ~cae rate o~~ no~t ~o exceed
eight percent per annmn ~der the mode of pa~ent oZ' Oonds as required by
law and the ordinances of ~he City of Bremerton. These bonds s~a~l Oe de-
livered ~o Ohe contractor in redemption oz' warrants on ~he local improve-
ment district z~ds issued on the esti~a~e oz' ~he City ~ngineer, or ~he City
of Bremerton may, at its option, sell said 0onds and maXe such redemption
in cash.
Section 8. That this ordinance s~all ~ake effect i~ediately following
its passage and publication, as provided ~y law.
PASSED by the City Council of the City of Bromerton, signed by the
