1784 and 1~90.
HE CITY 0F BREb~ERTON L~ES ORDAIN:
1. Section 3 oI' Ordinance 1461, as ~ended by Ordinances
1~5, and 1890, here0y is ~aended '~o read as follows:
It be unlawful I'or any person to display, exhibit or expose
permit to used, played or operated, or displayed, exposed or exhi~z~ed
for cZ~ use, play or opez'~ation z~or proi'it, any at~nusement devices
without a valid and subsisting zicense to be designated as "location
license", place of business which s~ail ~ave a "location license" is
required to ~, at all times ~eep sa~.d "location license" in a conspicuous
place o~ the ises covered Oy said license. The City Clerk shall pre-
scribe the fo~m the license snd said license shall ~e at the rate of
,~2o.00 per locati~ per year payable in advance to the City '['reasurer, val-
id to the next 30 oI' June, provided that the fee may ~e pro rated on
licenses issued the 31st o~' July, o~' any year.
Beginning July 1~51, the City Clerk shall issue sach
license" and no p firm or corporation except the owner, manager,
lessee, or other .n actual c~arge of the location sought to be lic-
ensed shall a~ply-for ;e issued a "location license" an~ az'ret ~he issu-
ance o~' such license the censee shall have the sole right to determine
which licensed operator sh~ 1 z'urnish machines ~ be used and operated in
such licensed premises.
It shall be unlawful i'd person to display, exhibit, e:~pose or
permit to ~ used any device, as defined herein, in any plac.s of
business where minoz-,s az~e in ~abi~ o.~' congregatin~ not accom?anie~ by
their parents or te~_al guardian ~d no license shall ce granted to any place
oi' ~usiness coming wit;~in ohe '~oi. nd: ctasslfmcation; provided, ~owever,
t~at whez~ever any applicant for a cation license isthe holder of a Class
"A" license as defined in Retain ~evised Statutes, Supplement
or the holder o~' a Class ~'B" license s defined in Re.mingtons ~evised Stat-
ur, es, Supplement 7306-23~N, or ~he h~ er of a Class "D" license as defined
in Remington's Revised S~atutes, Supr~l ent 7306-23-'1~, the stanza being.: the
laws o~' the State o~' ~ashington, suc~ t ~nse shall 0e prima facie evidence
t~at ~he ?remises yor wi~ich a location I e is requested does not fall
within 'the i'oregoin~5 cls~ssification.
Section ~. Section 4 o.U Ordinance 1461 as ~ended by Ordinance 1680
and 1890, is hereby ~ended to read as
Operator's License. I~ s~atl be unlawful or any person to oecome an
ope~ator of ~usemenc devices as here~n d ithout aaving a valid and
subsisting license, to be known as "operator's sement device license".
An operator's license shall be granted only to a rson who ms a citizen of
the United Sta~es, o~' good moral c~aracc~r and re ~tion, ~d w[~o, in the
opinion of the City Council, is a fit and proper- to be granted a
llcense, or such license may ce granted to a cdr or a partners~uip.
Tae City Co~cii, I'or the purposes o~' effectively llzng 'the operation
of amusement devices ~d knowing t~e requirements o~' ~er supervision of
the operators of such devices, ~ereby expressly reserves right and power
to grant, or refuse '~e same, a~nd ~he ~ec~sion of the Cit ;ouncil taereon
shall be final an,.~ ~onclusive. Beginning July 1, 1~5~, ai' r a'ppro~,~al 0y
the l~ayor ~d th~ City Council, each operator s~ali 0e is an "operator's
lmcense" 0y the City Cl~.~rk, valid from July i to J~e ~0 cz' e following
year, upon payment of an operator's license fee of ~2o00.00, yearly
in advance to the City Treasurer, provided that the fee may be rated, on
licenses issued az'ter the 31st cZ' July o~' any year.
