The alley in Block V of William Bremers First Addition, between Naval Avenue
and Hewitt Avenue by the construction of a 6 inch thick 14 foot wide concrete
alley pavement, all in acco rdance with the plans, maps, and speciI'ications on
file in the Office of the City Clerk, establishing an improvement district,
providing for the levying of assessments for the payment of such improvement
and making such improvement payable by bonds.
THE CITY OF BRE~IERTON DOES ORDAIN:
Section 1. 'l~at the Alley in Block ~ of William Bremers First Addition
between Naval Avenue and Hewitt Avenue be improved by the construction of a
6 inch thick 14 foot wide concrete alley pavement, together with the doing
of any and all other work in connection therewith as may be necessary to make
such improvement a complete job, all in accordance with the maps, plans and
specifications now on file in the Office oi' the City ~lerk oI' the City of
Bremerton.
Section 2. ~hat the cost and expense of said improvement shall be borne
by and assessed against the property included in the assessment district
hereinafter created, in accordance with the provisions oi' the Revised Code of
Washington 35.43.080 except such proportion oi' said cost as shall be borne by
and paid I'or by the State of Nashington or other governmental agency, which
proportion oI' such cost and expense is hereby declared to be in accordance
with the special benefits conferred upon such property.
Section 3. 'l~at thence is hereby established and created a local improve-
ment district to be called and known as "Local Improvement District No. 253",
the boundaries of which are described as .follows;
Beginning at the intersection of the centerlines of Naval Avenue with
Burwell Street; uhence East along the centerline of Burwell Street to the
Centerline of Hewitt Avenue; thence South along the centerltne of Hewitt
Avenue to the centerline of Gregory Way; thence .West along the centerline of
Gregory Way to the Centerline of ~aval Avenue; thence North along the center-
line of Naval Avenue to the centerltne of Burwell Street the point of begin-
ning.
Section 4. That the cost and expense of said improvement to be borne
by said Improvement Diatrict and exclusive oI' any portion borne by either
the State of Washington or other Governmental Agency shall be assessed
against said property included in said Improvement District in proportion
to said area, except certain units wherein the special Oenefits conferred upon
the property are not fairly reflected by the use of the termini and ~ne
method, the assessment shall be made against the property of the district in
accordance with the special Oenefits it will derive I'rom the improvement
without regard to the zone and termini method, and in accordance with the pro-
visions of the Revised Code of Washington 35.~3.080 and the remainder of said
cost of the improvement to be paid for by arrangement, ii' any, with the
State Of Washington or other Governmental Agency.
Section 5. Xhat bonds tearing interest at a rate of not more than six
percent per annum, payable on or before ten years from the date oi' issuance,
shall ~e issued in payment oi' the cost,nd expense or said improvement assess-
ed against the property included in the district hereinabove described which
bonds shall be redeemed by ~ collection of special assessments levied and
assessed against the property within said mistre&t, payable in equal annual
installments, with interest at the rate of not to exceed eight percent per
annum under the mode of payment oy Oonds as required by law and the ordinances
of the City of Bremerton. These bonds shall be delivered to the contractor
in redemption of warrants on the Local Improvement Oistrict funds issued on
the estimate of the City Engineer, or the City of Bremerton may, at its option
sell said bonds and ma~e such redemption in cash.
Section 6. That this ordinance shall take effect immediately following
its passage and publication, as provided by law.
PASSED by the City Council of the City of Bremerton, signed by the Mayor
and attested by the City Clerk in authentication thereof this 3rd day of
September, 1952.
