AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF: Scott Avenue from East llth
Street to East 13th Street by the construction of five foot concrete side-
walks and concrete curbs and gutters, all in accordance with the plans, maps
and specifications on file in the Office of the City Clerk, establishing an
improvement district, providing for the levying of assessments for the ?ay-
merit of such improvement and making such improvement payable by bon~]s.
THE CITY OF BRE~ERTON ~OES ORDAIN:
Section 1. Zhat Scott Avenue from East llth Street to East 13th Street
be improved by the construction of five foot concrete sidewalks and concrete
curbs and gutters, together with the doing of any and all other work in con-
nection therewith as may be necessary to make such improvement a complete
job, all in accordance with the maps, plans and specifications now on file
in the Office of the City Clerk of the City of Bremerton.
Section 2. ~hat the cost and expense of said improvement shall be
borne by and assessed against the property included in the assessment dis-
tract hereinafter created, in accordance with the provisions of the Revised
Code of Washington 35.43.080 except such proportion of said cost as shall be
borne by and pai~ for by the State of Washington or other governmental agency,
which proportion of such cost and expense is hereby declared to~ in accord-
ance with the special benefits conferred upon such property.
Section 3. Zhat there is hereby established and c teated a local improve-
ment district to ~ called and known as "Local Improvement District No. P57",
t~e boundaries of which are described as follows: Beginning at the intersec-
tion of the center lines of East llth Street and Scott Avenue; thence East
llS'; thence North along a line parallel to the centerline of Scott Avenue
to the center line of East 13th Street; thence West along the center llne of
East 13th Street 230'; thence South along a line parallel to and ll5' West
of the center line of Scott Avenue to East llth Street; thence East along
the center line of East llth Street llS' to its intersection with the center
line of Scott Avenue which is the point of beginning
Section 4. That the cost and expense of said improvement to be borne
by said Improvement District and exclusive of any portion borne by either
the State of Washington or other Governmental Agency shall be assessed a-
gainst said property included in said Improvement District in proportion to
sai~ area, except certain untts wherein the special benefits conferred upon
the property are not fairly reflected by the ~se of the 'ter~inl and zone
method, the assessment shall be made against the property of the district
in accordance with the special benefits it will derive from the improvement
without regard to the zone and termini method, and in accordance with the
provisions of the Revised Code of Washington 35.4~.080 and the remainder of
said cost of the improvement to be paidfor by arrangement, if any, with the
State of Washington or other Governmental Agency.
Section 5. That bonds bearing interest at the rate of not more than
six per cen per annum, payable on or before ten years from the date of issu-
ance, shall be issued in payment of the cost and expense of said improvement
assessed against the property included in the district hereinabove described
which bonds shall be redeemed by a collection of special assessments levied
and assessed against the property within said district, payable in equal
annual installments, with interest at the rate of not to e~ceed eight per-
cent per ann~ under the mode of payment by bonds as required by law and the
ordinances of the City of Bremerton. These bonds shall be delivered to the
contractor in redemption of warrants on the Local Improvement District funds
issued on the estimate of the City Engineer, or the City of Bremerton may,
at its option, sell said bonds and make such redemption in cash.
Section 6. That this ordinance shall take effect immediately following
its passage and publication, as provided by law.
PASSED by the City Council of the City of Bremerton, signed by the Mayor
and attested by the City Clerk in authentication thereof this 22nd ~ay of
July, 1953.
