AN O~{DIN~CE PROVIDING FOR THE IMPROVErs, lENT OF:
The Alley between Eighth Street and Ninth Street from Rainier Avenue to
Olympic Avenue by the Construction of a six (6) inch thick twelve (12) foot
wide concrete alley pavement, all in accordance with the plans, maps, and
specifications on file in the Office of the City Clerk, establishing a~
provement district, providing for the levying of assessments for the payment
of such improvement an5 making such improvement payable by bonds.
THE CITY OF BRER~ERTON ~ES ORDAIN:
Section 1. ~hat the Alley between Eighth Street and Ninth Street from
Rainier Avenue to Ol~pic Avenue be improved by the construction of a six
(6) inch thick twelve (12) foot wide concrete alley pavement, together, with
the doin~ of any and all o'ther work in connection therewith as ma7 be nec-
essar7 to make such improvement a complete job, all in accordance with the
maps, plans and specifications now on file in the office of the Cit~ Clerk
of the City of Bremerton.
Section 2. 'hat the cost and expense of said improvement shall be borne
by and assessed against the property included in the assessment district here-
inafter created, in accordance with the provisions of the [~evised Co~e of
~,"~ashington 35.43.080 except such proportion of said cost as shall be bor'ne
by an~ paid for by the State of ~,'ashington or other gover~nental ag]ency, which
propo~tlon of such cost and expense is hereby declared to be in accordance
v~ith the special benefits conferred upon such property.
Section 3. That there is hereby established and created a Local Improve-
ment District to be called and known as "Local Improvement District No. 254",
tke bo~daries of which are described as follows;
i~eginning at the intersection of the centerlines of ~inth Street with
l~ainier Avenue; thence East along the centerline of i~inth Street to its in-
tersection with ~he Centerline of Ol~pic Avemue; thence South along the
centerline of Ol~pic Avenue to its intersection with the centerline of
Eig[~th ~treet; thence West along the centerline of Eighth Street to the ~en-
terline of Rainier Avenue. thence North along the centerline of Rainier Ave-
hue to its intersection with the centerline of l'~inth Street which is the
point of beginning.
Section 4. That the cost and expesnse of said improvement to be borne
by said Improvement ~istrict and exclusive of any portion borne by either
the State of Washington or other Gover~ental Agency shall be assessed against
said property included in said Improvement District in proportion to said
area, exceot certain units whe~ein the special ~nefits conferred upon the
property are not ]~'airly reflected by the use of the temini and zone method,
the assessment shall be made against the property of the ~istrict in accord-
ance with the special benefits it will derive from the improvement without
regard to the zone and termini method, and in accordance with the provisions
of the [levised Co~]e of Washington 35.43.080 and the remainder of said cost of
the improvement to be p~.~id for by arrangement, if ~y, with the State of
',~ashington or other Gover~aental Agency.
Section 5. That bonds bearing interest at the rate of not more than six
pe:e cent ( ~
6h) per ann~, payable on or before ten (10) years from the date of
is~suance, shall ce issued in pa)~ent of the cost and expense of said improve-
merit ~ssessed against the property included in the district hereinabove
cribed which bonds shall ~ redeemed by a collection of special assessments
levied and assessed against the property within said district, payable in
equal annual installments, with interest at the rate of not to exceed ei~j;ht
per cent (8~) per annEa ~der the mode of payment by bonds as required by law
and the ordinances of the City of Bremerton. These bonds shall be delivered
to Ohe contractor in redemption of warrants on the Local improvement District
funds issued on the esgimate of the City Engineer, or the Otty of Bremerton
ma~y, at its option, sell said bonds and make such redemption in cash.
Section 6. That this ordinance shall take effect i~ediately following
its passage and publication, as provided by law.
