AN ORDINANCE vacating certain property heretofore dedicated as a
street and acquired for street purposes but not used or necessary for a
right-of-way in National Avenue, situated in the City of Bremerton.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. £hat there has been previously filed with the City Coun-
cil a petition requesting that certain property hereinafter described and
heretofore dedicated for street purposes and acquired for street purposes
but not used in the right-of-way or for street purposes in National Ave-
nue be vacated, and that a resolution .favorin& the vacation was adopted
by the City Council of Bremerton on the 16th day of Zpril, 1954, and set-
ting the 12th day of May, 1954, as the date upon which said petition would
be heard and that notice of said hearing has been posted and given in the
manner provided by law.
Section 2. ~hat said property, legally known and described as fol-
lows, to-wit:
That portion of the North half, except the South 20 feet,
of the Southeast quarter of the Southwest quarter of
Section 15, Township 24 North, Range 1 East, W.M., con-
veyed to the City of Bremerton for street purposes, by
J. V. Carnahan and ~ersidia Carnahan, husband and wife,
by deed recorded in Volume 579 of Deeds, Page 416, and
under Auditor's File No. 587290, Records of Kitsap County,
washinoton; and by Arnold S. Wang and Myrtle Wang, husband
and wife, by deed recorded in Volt~e 576 of Deeds, Page
154, and under Auditor's File No. 583474, Records of
Kitsap Cotmty, Washington, lying East of a line 40 feet
East of and parallel to 'the following described center
line of National Avenue as it now exists.
Beginning on the ~est line of the Southeast quarter of
the Southwest quarter of Section 15, Township 24 North,
Range i East, W.M., which bears North 1° 26~ 39" East,
at a point which is the Southwest corner of the North
half of the said Southeast quarter of the Southwest
quarter of said section; thence running North 3° 06, 43"
East. ALSO
That portion of National Avenue, as established by the
Superior Court of the State of Washington, in and for the
County of Kitsap, in case number 2197 (Dressel vs. Jensen),
lying North of~the South line of Government Lot l, Section
15, Township 24 North, Range I East, W.N., except that por-
tion comprising the Easterly continuation of 7th Street,
(formerly Harrison Street).~ as established in said Superior
Court case number 2197, which is not included in 5he following
described tract:
A strip of land, 80 feet wide, being 40 feet on either
side of the following described center line.
Beginning on the West line of the Southeast quarter of
the Southwest quarter of Section 15, Township 24 North,
Range i East, W.~., which bears No~'th 1° 26' ~9" East,
at a point which is the Southwest corner of the ~orth
half of the Southeast quarter of the Southwest quarter
of said Section; thence running North ~o 06'4Z" East.
be, and the same hereby is declared vacated but the City of Bremerton
does hereby reserve and retain an easement for any public utilities,
including sewer and wa~er lines, telephone and power cables which may now
be under the surface of any of the area vacated, and the City of Bremerton
also retains the right to exercise and grant easements in respect to the
area hereby vacated for the construction, repair and maintenance of public
utilities and services.
The City Clerk is authorized to certify a copy of this ordinance to
be a true and correct copy he~.eof and to file the same for recording by
the Auditor of Kitsap County, Washington
APPROVED on first reading this 12th day of ~ay, 1954.
PASSED on second reading by the City council of the City of Bremerton,
signed by the Mayor and attested 'by the City Clerk in authentication of such
passage this 19th day of May, 1954..~
