A[~ ORDINANCE providing for 'the improvement of: Ironsides Avenue
from East 13th Street to East 16th Street by the construction of concrete
curbs and gutters, all in accordance with the plans, maps and specif.~ca-
tions on file in the Office of the City Clerk, establishing an improve-
ment district, providing for the levying of assessments for the payment
of such improvement and making such improvement payable by bonds.
TII'E C]~TY OF BREMERTON [~ES ORDAIN:
Section 1. 'i'hat Ironsides Avenue from East 13th Street to East 16th
Street be improved by the construction of concrete ~urbs and gutters, to-
gether with the doing of any and all other work as may be necessary in
connection therewith to make such improvement a complete job, all in ac-
cordance with the maps, plans anm specifications now on file in the Office
of the City Clerk of the City of Bremerton.
Section 2. That the cost and expense of said improvement shall be
borne by and assessed against the property included in the assessment dis-
trict hereinafter created, in accordance with trio provisions of the Revised
Code of ~ashington 35.43.080 except such proportion of saiO cost as shall
be borne andpaid for by the State of ¥~ashington or other governmenttal agency
which proportion of such cost and expense is hereby ~Je¢lared to be in ac-
cordance with she sgecial benefits conferred, upon such property.
Section 3. 'that there is hereby established and created a local im-
provement district to ~ called and known as "Local Improvement District No
263", the boundaries of which are described as follows: Beginning at the
intersection of the centerline of East 13th Street with the centerline of
Ironsides Avenue; thence East along the centerline of East 13th Street 133.
50 feet; thence ~,[ortk naraiiet)to and 133.50 feet East of the center].ine of
Ironsides Avenue to a point which is 26.5 feet South of the Centerline of
East 16th Street; thence West parallel to and 26.5 feet South of the center-
line of East 15th Street to a point Rhich is 133.50 feet West of the 8enter-
line of Ironsides Avenue; thence South parallel to s nd 133.50 feet '~est of
the Cen~erline off Ironsi,::ies Avenue to the censerline of East 13th Street;
thence East 1~3.50 feet to the point of' beginning.
Section 4. ~hat the cost and expesne of said improvement to 0e 0orne
by said Improvement District and exclusi~e of any portion 0orn. e bye ither
the SCare of ?i~shington or other governmental a...ency shall be assessed a-
sains~ said property included in said Improvement ~istrict in proportion
to sai~ ar, sa, except certain units wherein Sh~-~ special oenefits con~'erred
upon the property are not 2'airly reflected by the use of 'the termini and
zone method, she assessmenc shall ~..~e made abainst the property of the dis-
trict in accordance with the special 0enefits it will derive from the im-
provement without regard to the zone and termini method, and in aecor~ance
with she provisions oz' the ttevised Code of Washington 35~43o080 amd the
remainder of sai~ c~oo~ ..... -- ~, the imp~ovement to oe paid For by arrangement,if
any, with the State of Washin~ton or other governmental aoency.
Section 5. That bonds bea~ing interest at not more than six 9er cent
per annum, payable on or before ten years from the date of issuance, shaI1
be iss~ed in payment of the cost and exoense of sai~ ]mprovement assessed
against the property included in the district hereinabove 5escribed which
bonds shall be redeemed 0y a collection of s~ecial assessments levye5 and
assessed against the property' within the c~istrict, payable in equal annual
installments with interest at the rate of not to exceed eight per cent ocr
annum under the mode of payment by bonds as required by ].aw and the ordin-
ances of ~½e City of Bremerton. These 'bonds shall 0e ~elivere~ to the Con-
tractor in re,emotion of warrants on the Local Improvement District funds
issued on the estimate of the C_~.ty Engineer, or the City of Bremerton may,
at its o[stion, sell said bonds and make such fedora.orion ia cash.
Section 6. ~'hat tb~s Ordinance shall take effect immediately follow-
ing its passage and publication, as required by law.
