HomeMy WebLinkAbout2238 ORDINANCE NO. 2238 AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF: The Alley, 90 feet East of Warren Avenue from 10th Street to llth Street by the laying of blacktop 2 inches by 16 feet wide, and the providing of drainage therefor; all in ac- cordance with the plans, maps, and specifications on file in the office of the City Engineer; establishing an improvement district, providing for the levying of assessments for the payment of such improvement and making such improvement payable by bonds. THE CITY OF BREMERTON DOES ORDAIN: Section 1. That the Alley, 90 feet east of Warz~en avenue, from 10th Street to llth Street be improved by the laying of blacktop 2 inches thick by 16 feet wide, and the providing of drainage therefor, toge'ther with the doing of any and all work in connection therewith as may Oe necessary to make such improvement a complete job, all in accordance with the maps, plans and specifications now on file in the office of the City Engineer of the City of Bremerton. Section 2. '£hat the cost and expense of said improvement shall be borne by and assessed against the property included in the assessment district here- inafter created, in accordance with the provisionsof the Revised Code of Wash- ington 35.43.080 except such proportion of said cost as shall be borne by and paid for by the State of Washington or other governmental agency, which pro- portion of such cost and expense is hereby declared to be in accordance with the special benefits conferred upon such property. Section 3. Zhat there is hereby established and created a local improve- ment district to be called and knows as : Local Improvement-District No. 274, the boundaries of which are described as follows: Beginning at the Northeast corner of 10th Street and War~'en Avenue; thence North along the East margin of Warren Avenue 302.04 feet to the Southeast corner of llth Street and War- ren Avenue; thence East along the South margin of llth Street 200 feet; thence South ~.nd parallel to the East margin of Warren Avenue a distance of 302.18 feet to the North margin of 10th Street; thence West 200 feet along the North margin of 10th Street to the Nomtheast corner of 10th Street and Warren Aven- ue, the place of beginning. Section 4. That the cost and expense of said improvement ~o be bo me by said improvement district and exclusive of any portion borne by either the State of Washington or other governmental agency shall be assessed again- st said property included in said Improvement ~istrict in proportion to said area, except certain units wherein the special benefits conferred upon the peoperty are not fairly reflected by' the use of the termini and ~ne method, the assessment shall be made against the property of the district in accord- ance with the special benefits it will derive from the improvement without regard to the zone and termini method, and in accordance with the provisions of the Revised Code of Washington 35.43.080 and the remainder of said cost of the improvement to be paid for by- arrangement, if any, with the State of Wash- ington or other Governmental Agency. Section 5. That bonds bearing interest at a rate of not more than six percent per annum, payable on or before ten years from the datecof issuance shall be issued in payment of the cost and expense of said improvement asses- sed against the property included in the dist~ict hereinabove described which bonds shall be redeemed by a collection of special assessment levied and as- sessed against the property within said district, payable in equal annual in- stallments, with interest at the rate of not to exceed eight per cent per an- num Under the mode of payment by bonds as required by law and the ordinames of the City of Bremerton. These bonds shall be delivered to the contractor in redemption of warrants on the Local Improvement District funds issued on the estimate of the City Engineer, or the City of Bremerton,may, at its optior sell said bonds and make such redemption in cash. Section 6. That this Ordinance shall take effect immediately following its passage and publication as provided by law.
