AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF: East 18th Street,
from Trenton Avenue to 500 feet West, by the construction of an eight
(8) inch sanitary sewer, together with lampholes, manholes and appurt-
enances; all in accordance with the plans, maps, and specifications on
file in the office of the City Engineer, establishing an improvement dis-
trict, providing for the levying of assessments for the payment of-such
improvement and making such improvement payable by bonds.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. That East 18th Street, from Trenton Avenue to 500 feet
West be improved by the construction of an eight (8) inch sanitary sewer,
together with lampholes, manholes and appurtenances; together with the
doing of any and all work in connection therewith as may be necessary to
make such improvement a complete job, all in accordance with the maps,
pland ans specifications now on file in the Office of the City Engineer
of the City of Bremerton.
Section 2. That the cost and expense of said improvement shall be
borne by and assessed against the property included in the assessment dis-
trict hereinafter created, in accordance with the provisions of the Revised
Code of Washington 35.43.080 except such proportion of said cost as shall
be borne by and paid for by the State of Washington or other governmental
agency, which proportion of such cost and expense is hereOy declared to be
in accordance with the special benefits conferred upon such property.
Section 3. That there is hereby established and created a local im-
provement district to Oe called and known as: LOCAL IMPROVEMENT ~I~TEICT
NO. 273, comprising a tract of land, the boundaries of which~are desc~ bed
as follows: Beginning at the Southwest Oorner of Lot ll, E.A. Renn Addi-
tion to the City of Bremerton; thence north 135.17 feet to the Northwest
corner of said Lot ll; thence East 300.14 feet; thence south 82.5 feet;
thence West 19 feet; thence South 82.~il. feet; thence East V4 feet; thence
South 165 feet; thence West 243.98 feet; thence North 135.17 feet; thence
West 111.68 feet; thence North 60 feet to the point of beginning.
Section 4. That the cost and expense of said improvement be borne
by said improvement district and exclusive of any portionborne by either
the State of Washington or other governmental agency shall be assessed a-
gainst said property included in said Improvement Dist~ct in proportion to
said area, except certain units wherein the special benefits conferred up-
on the property are not f~irly reflected by the use of the termini and zone
method, the assessment shall be made against the property of the district
in accordance with the special benefits it will derive from the improvement
without regard to the zone and termini method, and in accordance with the
provisions of the Revised Code of Washington 35.45.080 and the remainder of
said cost of the improvement to De paid for by arrangement, if any, with
the State of Washington or other governmental agency.
Section 5. That bonds bearing interest at a rate of not more than six
per cent per annum, payable on or before ten years from the date of issuance,
shall be issued in payment of the cost and expense of saidimprovement ass-
essed against the property included in the district hereinabove described
which Oonds shall be redeemed by a collection of special assessment levied
and assessed against the property within said district, payable in equal
annual installments, with interest at the rate of not to exceed eight per-
cent per annum under the mode of payment by bonds as required by law and
the ordinances of the City of Bremerton. These bonds shall be d~ivered
to the contractor in redemption of warrants on the Local Improvement Dis-
trict Funds issued on the estin~te of the City Engineer, or the City of
Bremerton may, at its option, sell said bonds and make such redemption in
cash.
Section 6. That this ordinance shall take effect immediately follow-
ing its passage and publication, as provided by law.
PASSED by the City Council of the City of Bremerton, signed by the May-
or and attested by the City Clerk in authentication thereof this 21st day
of Augst, 1957.
