AN 0RD~NANCE P~O¥IDING FOR THE I~iPR0VEMENT OF: Brashem Avenue and
East 23rd Street, from Cascade Trail to Nipsic ~venue, 0y construction of
five foot concrete sidewalks on the west side of Brashem Avenue an~ con-
crete curbs and gutters on bot~: sides of Brashem Avenue and East 23rd
Street; all in accordance with the plans, maps, an~ specifications on i'ile
in the office of the City EnLineer; es ablishing an improvement distz~ict,
providin~o for the levying of assessments for the payment c.Z' such improve-
merit and makin:_, such improvement payable by bonds.

Section 1. ~hat Brashem Avenue and East 23rd Street, from Cascade
Trail to Nipsic Aven~e be improved by construction of five foot sidewalks
on ~he wast side of Srashem Avenue and c. ncrete carbs and gutters on both
sides of Brashem Avenue and East ~3rd Street; tocle~her with ~he doinS of
any and all work in connection therewith as may be necessary to make such
improvement a complete job, all in accordance with the maps, plans and
specifications now on file in the Office of the City Engineer of the City
of Bremerton.
Section 2. ~hat the cost and e:~.~ense of said improve.;~nt siuall be
borne by ~nd assessed against the prop~rty included in the assessment dis-
trict hereinafter created, in accordance with the provisions of the Revis-
ed Code of Washington 35.43.080 except such pi~oportion of said cost as shall
be borne by andpaid for by the State of Washington or other Sovor~ental ag-
ency, which proportion of such cost a~d expense i's hereby declareO to be in
accordance with the special benefits conferred upon such property.
Section 3. That there is hereby established and created a io~al im-
pro~zemen't district to ~e called and known as "Local Improvement District No.
~VY", the boundaries of which are descrioed as follows:

line midway betwee~ said Avenues t~ a point on the South line of
t~e North: hall' of the ~Jo th half of the Southeast quarter of the
Southeast quarter of said Section 1Z; thence Easterly alonL said
South line to a point on the West margin of Brashem avenue which
is the West line of the recorded plat of Wischhoefer Addition;
thence Northerly alona the ¥~'est line of said plat to the North-
west corner of s~id plat; thence easterly' alon~ the ~Jorth line
of said plat beina also the ~outh line of the re~rded plat of
Brewer Addition to the cent~::rline of Nipsic Avenue; thence South-
erly along said centerline t~ a point on the Easterly extension
of t~e lot line between lots 18 and 19, plat of Wischhoefer Add-
ition; t[~ence Westerly alon..j, said lot line t.~: a point midway be-
tween ~ras[~em Avenue a~;d [~ipsic Avenue; thence Southerly along
said median line to a point on the [..]orth line of the South half
of the South half' of the Southeast quarter of the Southeast quar-
ter of said Section 12; thence Westerly along said subdivision
line to the point of beginning.
Section 4. ~'hat the cost an~ e:~yense of said improvement to be borne
by sald~ Improveme~t ~istrict a~d exclusive of tony portion '~orne by either
the State of ~¥as?~ington or other ~over~ental Agency si~all ~.e assessed a-
gainst said p~opertj included in saJ~d Improvement ~istrict in proportion to
sai~ area, e~ce~t certain units wl~erein the special benefits conferred upon

Section 5. Zhat bonds bearing interest at a rate of not more t?~a~ six
per cent per a~n~., paya01e on or before ten years from the date of issuance,
shall ce issued in payment of the cost and e~pense of said improvement asses-
sed against the property included in the ~istrict hereinabove described
whica bonds shall be redeemed b0 a collection of special assessment levied
and assessed against the property within said district, payable in eq~ in-
stallments, t~.,ith interest at the ra.:~e of not ~o exceed eight percent per an-
n~ under the ~ode of payment by bonds as required by law and the c:rdinances
of the City of Bremerton. These bonds shall be delivered tc~ the contractor

in redemption of warrsnts on the Local Improvement ~istrict funds is-
sued on the estimate of the City En~jineer, or the City of Bremerton
may, at its option, sell saJ_d bonds and make such redemption in cash.
Section 6. l'hat this Ordinan~:e shal_l take effect immediately
following its pass_age and publicatio~, as provided by law.
PASSED by the City Council of the City of Bremerton, signed by
t~e Mayor and attested by the City Clerk in authentication thereof
this 14th day of Au,~:ust, 1957.
