HomeMy WebLinkAbout2219 ORDINANCE NO. 2219 AN ORDINANCE PROVIDING FOR THE Ii{PROVEMENT 0F Ironsides Avenue, fmm Shore Drive to East llth Street, by clearing and grading for and the con- struction of five foot sidewalks, concrete curbs and gutters, and ~rovi~- lng for drainage, all in accordance with the plans, maps and specifications on rile in ~he Office of the City Clerk, establishing an improvement dis- trict, providing for the levying of assessments for the payment of s nth improvement and making such improvement payable by'bonds. THE CITY OF BREMERTON ii{lES ORDAIN: Section 1. i~hat Ironsides Avenue, from Shore Drive to East llth Street be improved by clearing and grading for and the construction of five foot sidewalks, concrete curbs and gutters, and providing for drain- age; together with the doing of any and all wor~{ in connection therewith as may se necessar2' to make such improvement a complete job, all in accord- anco with ~he maps, plans and specificiations now on file in ~he Office of the Oity Clerk of the City of Bremerton. Section ~. That the cost and expense of said improvement shall be borne by and assessed against the prope~.oy included in the assessmen~ dis- trict hereinafter created, in accordance with the provisionsof the Revised Code of Washington S~.45.080 except such proportion of said cost as shall be borne by and paid for by the State of }~'ashington or other 8iovernmental agency, which proportion of such cost and expense is h~reby declared to be in accordance with the special ~enefits conferred upon such property. Section S. i'hat there is hereby established and created a local im- provement district to be called and known as Local Improvement Oistrict No. ZTO, the boundaries of which are described as follows: Beginning at the intersection of the cen~erline of Ironsides Avenue with the Center- line of Shore Drive; thence East along the centerline of Shore Drive 140 feet; thence North to a poin~ oP. the centerline ofEast llth Street which is 12~ feet Ea-~st of the center].ine of Ironsides Avenue; thence '~est along the centerline of East llth Street to a poin~ which is 1~6 feet ~esL of 'the cen~erline or Ironsi.~es Avenue; thence Court to a point on Shore Drive which is 1~4 fee~ west of the centerline of Ironsides Avenue; thence East alon6 the centerline of Shore Drive ~o i~s intersection with the center- line of Ironsides Avenue, the point of beginning. Section 4. 'that the cost and expense of said improvement to be borne by said Improvem,~nt ~istrict uno exclusive of any portion borne by either the State of {'~ashington or other Governmental Agency shall se assessed a- gainst said property included in said Improvement i)istrict in proportion to said area, except certain units wherein the special benefits conferred upon ~he property are no~ fairly reflected by the use or the termini and s. one method, ~he assessmen~ shall he made against the property of the dis- trict in accordance with the special benefits it will derive from the im- provement without ~'~egard to the zone ann termini method, and in accordance with 'the provisions of the R~vi~ed {_lode of '~ashington S$.4~.080 a~d the re- mainder or said cos~ of' the improvement to ~ e paid for by arrangement, if any, with she State of ~ashington or toter governmental aaency. Section 6. That ~his ordinance shall take effect immedia~sely rollowing its passa~3e and publication, as provided by law.
