FOR £HE IMPROVE~ENT OF the Alleys in Blocks 1 and 6, Dietz's Addition all in accordance with the plans, maps, and Specifications'on~:fil~iln.!the office of the City Engineer; adopting said plans, maps and specifications; establishing an improvement district; pro- viding for the 1 vying of assessments for the payment of such improvement and making such improvement payable by bonds. THE CITY 0F BREMERTON DOES ORDAIN: Section 1. ~'hat the Alleys in Blocks 1 and 6, Dietz's Addition be improved by proper grading, base preparation, and surfacing with 0itumin- ous materials, together with the doing of any and all work in connection therewith as may be necessary to make such improvement a complete job, all in accordance with the maps, plans and specifications now on file in the office of the City Engineer of the City of Bremerton. Section 2. ~'hat the maps, plans and specifications prepared by the City Engineer, now on file in the office of said City Engineer, for the aforesaid improvement ~e and the same are hereby adopted. Se~tion 3. That the cost and expense of said improvement shall be borne by and assessed against the property included in the assessment dis- trict hereinafter created, in accordance with the provisions of the Revis- ed Code of Washington 35.~3.080 except such proportion of ~id cost as shall be borne by and paid for by the State of Washington or toher govern- mental agency, which proportion of such cost and expense is hereby declared to be in accordance with the special benefits conferred upon such prope~ty. Section 4. ~'hat ~he,~-e is hereby established and created, a local im- provement ~istrict robe called and known as: Local Improvement District No. 282, the boundaries of which are described as follows: Block 1, of Dietz's Addition, as shown on the plat recorded in Vol. 2 of plats, page 57, records of Kitsap County, Washington. EXCEPT the E~ of Lots 20 and ~1 of said block 1, and ~XCEPT the E~ of the N~ of Lot 22 of said Block 1. ALSO Block 6 of Dietz's Addition, as shown on the plat recorded in Vol. 2 of plats, page 57, records of Kitsap County~ Washington. EXCEPT the S 58 feet of Lot 9 and the S 58 feet of the W ~0 feet of Lot 8 of said Block 6, and EXCEPT the E V9 feet of Lots 20 and 21 of said Block 8. Section 5. That the cost and expense of said improvement to be borne by said improvement ~istrict and exclusive of any portion borne by either the State of Washington or other governmental agency shall be assessed a- gainst said property included in said Improvement ~istrict in proportion to said area, except certain ~nits wherein the special benefits conferred upon the property are not fairly reflected by the use of the termini and zone method, the assessment shall be made against the prope~ty of the district in accordance w~th the special benefits it will derive from the improvement without regard to the zone and termini method, and in accordance with the provisionsof t~e Revised Code of Washington 35.43.080 and the remainder of said cost of the improvement to Se ~aid for by arrangement, if any, with the State of Washington or other ~;overnmental agency. Section 6. That bonds bearing interest at a rate of not more than six percent per annum, payable on or Sefore Five (5) years from the date of issuance, shall be issued in payment of ~he cost and expense of said improve- ment assessed against the property included in the district heretnabove des- cribed which bonds shall be redeemed by a collection of special assessment levied and assessed aga~ns.t the property within said district, payable in equal annual installments, with interest at the rate of not to exceed eight percent per annum under the mode of payment by bonds as required by law and the ordinances of the City of Bremerton. These ~nds shall be delivered to the contractor in redemption of warrants on the Local Improvement District funds issued on the estimate of the City Engineer, or the City of Bremerton may, at its option, sell said 0onds and make such redemption in cash. Section 7. ~'hat this Ordinance shall take effect i~edlately following its passage and publication, as provided by law.
