AN ORDINANCE PROVIDING-FOR THE IMPROVEMENT OF:
Cherry Avenue, from Sheridan Road to 875 feet north;
Lindberg Place; ~i~lett Place; and both alleys in the
Plat of Halverson Third Addition,
Ail in accordance with the plans, maps and specifications on file in the
office of the City Engineer; adopting said plans, maps and specifications;
establishing an improvement district; providing for the levying of assess-
ments for the payment of such improvement and making such improvement pay-
able by bonds.
THE CITY OF BRES~ERTON DOES ORDAIN:
Section 1. That Cherry Avenue, from Sheridan Road to 875 feet north;
Lindberg Place; Giblett Place; and both alleys in the Plat of Halverson
Third Addition be improved by the construction of an 8 inch sanitary sewer
and appurtenances, together with the doing of any and all work in connect-
ion therewith as may be necessary to make such improvement a complete Job,
all in accordance with the maps, plans and specifications now on file in
the office of the City Engineer of the City of B~emerton.
Section 2. That the maps, plans anm specifications prepared by the
City Engineer, now on file in the office of said City Engineer, for the a-
foresaid improvement be and the same are he~',eby adopted.
Section 3. '£hat the ~ost and expense of said improvement shall be
borne by and assessed against the property included in the assessment dis-
trict hereinafter created, in acco~.dance with the provisions of the Revised
Code o~ Washington 35.43.080 except such proportion of said cost as shall
be borne by and paid for by the State of Washington or other governmental
agency, which proportion of such cost and expense is hereby declared to be
in accordance with the special benefits conferred upon such proper~y.
Section 4. ~'hat the~,e is ~ereby established and created a local im-
provement district to be called and known as: Local Improvement District
No. tV?, the boundaries of which are described as follows: Those proper-
ties shown on sheet 2 of the plat of Halverson Third Addition, recorded in
Volume 9 of Plats, Pages 18, 19 and 20, records of Kitsap County, Washing-
ton, excepting therefrom Lots 27, 33 and 36.
Section 5. That the cost and expense of said improvement to be borne
by said improvement ~iistrict and exclusive of any portion borne by either
the State of Washington or other governmental agency shall be assessed eq-
ually against said property included in said Improvement ~istrict, except
certain units wherein the special oenefits conferred upon the property are
ncc fairly reflected by the zone and termini method, the assessment shall
be made against the property of the district in accordance with the special
benefits i~ will derive from the improvement without regard to the zone and
termini method, and in accordance with the provisions of the Revised Code
of Washington 35.43.080 and the remainder of said cost of the improvement
to be paid for by arrangement, if any, with the State of Washington or
other governmental agency.
Section 5. That bonds bearing interest at a rate of not more than
six perceflt per annum, payaOle on or before lO years from the date of is-
suance, s~all be issued in payment of the cost and expense of said improve-
ment assessed against the property included in the district hereinabove
descrived which bonds shall be redeemed by a collection of special assess-
ment levied and assessed against the property within said district, pay-
able in equal annual installments, with interest at the rate of not to ex-
ceed eight percent per annum under 'the mode of payment by bonds as requir-
ed by law and the ordinanca~s of the City of Bremerton. 'I~ese oonds shall
be delivered to the contractor in redemption of warrants on ~he Local Im-
provement District funds issued on the estimate of the City Engineer, or
the City of Bremerton may, at its option, sell said bonds and make such
redemption in cash.
Section V. That this Ordinance shall take effect immediately follow-
ing its passage and publication, as provided by law.
PASSED by the City Council of the City of Bremerton, signed by the May-
or and attested by the City Clerk in authentication thereof this 4th day of
March, 1959.
