AN ORDINANCE PROVIDING FOR THE IMPROV~.~Arr OF: Edgewood Drive
all in accordance with the plans, maps, and specifications on file in the office
of the City Engineer; adopting said plans, maps and specifications; establishing
an improvement district; providing for the levying of assessments for the payment
of such improvement and making such improvement payable by bonds, warrants, or
installment notes ~
THE CITY OF BRE~fl~RTON DOES ORDAIN:
Sectian 1. That the above area be ink, roved by the construction of
Concrete Curbs, Gutters and Asphaltic Surfacing,
together with the doing of any and all work in
connection therewith as may be necessary to make such improvement a complete job,
all in accordance with the maps, plans and specifications now on file in the office
of the City Engineer of the City of Bremerton.
Section 2. That the maps, plans and specifications prepared by the City Engineer,
now on file in the office of said City Engineer, for the aforesaid improvement be and
the same are hereby adopted..
Section 3. That the cost and exqoense of said improvement shall be borne by
and assessed against property included in the assessment district hereinafter created,
in accordance with the provisions of the Revised Code of Nashington 35.43. 080 except
such proportion of said cost. as shall be borne by and paid for by the State of
Washington or other governmental agency, whicJ% proportion of such cost and expense
is hereby declared to be in accordance with the special benefits conferred upon
such property.
Section 4. That there is hereb)' established and created a local improvement
district to be called and kmown as:
Local Improvement District No. 323
Lots 3 and 4 of Edgewood Addition, and Lots 41 thru 44 of Vue West 1st Addition,
Section $. That the cost and expense of said improvement to be borne by said
improvement district and exclusive of any portion borne by either the 'State of
~ashington or other governmental agency shall be assessed against said property included
in said property included in said improvement district in proportion tO said area,
except certain units ~vherein the special benefits conferred upon the property are
not fairly reflected by the use of the termini and zone method, the assessment shall
be made against the property of the district in accordance with the special benefits
it will derive fran the improvement without regard to the zone and termini method,
and in accordance with the provisions of the Revised Code of l:'ashington 55.45. 080 and
the remainder of said cost of the improvement to be paid for by arrangement, if any,
with the State of l~ashington or other governmental agency.
Section 6. That bonds, warrants or installment notes bearing interest at a
rate of not more than ,~ ~ percent per annum, payable on or before, k years
from the date of issuance, shall be issued in payment of the cost and expense of
said improvement assessed against the property included in the district hereinabove
described which bonds, warrants or installment notes shall be redeemed by a collection
of special aSsessment~ levied and assessed against the property within said district,
payable in equal installments, with interest at the rate of not to exceed ~:.~ ~ percent
annum under the mode of payment by bonds, ~arrants or installment notes as required
by law and the ordinances of the City of Bren~erton. l~ese bonds, warrants or instal-
lment notes shall be delivered to the contractor in redemption of ~arrants on the
Local Improvement District funds issued on the estimate of the City Engineer, or the
City of Bremerton may, at its option, sell the bonds, ~,,arrants or installment notes
and make such redemption in cash.
Section 7. That this Ordinance shall take effect i]~ediately following its
passage and publication, as provided, by
