AN ORDINANCE amending the use and area maps of Ordinance
No. 1792; and rePe~tng Ordinance No. 2923.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. Ordinance No. 2923 is repealed.
Section 2. Pursuant to Planning Commission Resolutlnn No.
195 (corrected) of the City of Bremerton, the use and area maps of
Ordinance No. 1792 be, and they hereby are, amended in conformity with
Chapter I, Section 4 thereof as follows:
(a) Northeast quarter of the Southeast quarter Section
,
20, Township 24 North, Range I East, W.M., in
Kitsap County, Washington.
(b) South half of the Southeast quarter of the Northeast
quarter, Section 20, Township 24 North, Range I East,
W.M., in Kitsap County, Washington; EXCEPT the East
one-quarter thereof.
(c) South half of the Southwest quarter of the Northeast
quarter; EXCEPT the West one-quarter thereof: ALL in
Section 20, Township 24 North, Range I East, W.M. in
Kitsap County, Washington; EXCEPT County Road.
(d) East 450 feet of the South 500 feet of that portion
of the following described tract lying North of the
North line of Werner Road. North half of the South-
east quarter of the Northeast quarter, EXCEPT the
East one-quarter thereof, Section 20, Township 24
North, Range 1 East, W.M., in Kitsap County, Wu.
be, and the same hereby are reclassified from Residential-One (R-l)
to Residential-Two (R-2).
The use and area maps of Ordinance No. 1792 are further
amended in conformity with Chapter l, Section 4 thereof as follows:
(e) South 500 feet; EXCEPT East 450 feet thereof, of that
portion of the following described tract lying North
of the North line of Werner Road; North half of the
Southeast quarter of the Northeast quarter; EXCEPT
the East one-quarter thereof, Section 20, Township 24
North, Range I East, W.M., in Kitsap County, Wu.
be, and the same hereby is reclassified from Residential-One (R-l)
to Business-Two (B-2) with land use restrictions.

DECLARATION OF LAND USE RESTRICTIONS
In consideration of the rezone of the hereafter described
property JAMES E. SKIRVING, as the owner of the following described
real property situated in the City of Bremerton, County of Kitsap
Washington;
Rezone from R-1 to R-2:
(a) Northeast quarter of the southeast quarter, section 20
Township 24 North, Range 1 East, W.M. in Kitsap County
Washington.
(b) South half of the ~'E 1/4 of the NE 1/4, Sec. 20, T24N
R1E. W.M. in Kitsap County, Washington; EXCEPT th
E 1/4 thereof.
(c) South half of the SW 1/4 of the NE 1/4; EXCEPT the
W 1/4 thereof; all in Sec. 20, T24N, R1E, W.M.
in Kitsap County, Washington; EXCEPT County road.
(d) East 450 feet of the South SO0 feet of that portion
of the following described tract lying North.of the
North line of Werner Road. North half of the Southeast
Quarter of the NE 1/4 EXCEPT the E 1/4 thereof,
Section 20, Township 24 North, Range 1 East, W.M.,
in Kitsap County, Washington.
Rezone from R~i to B-2:
(e) South 500 ft; EXCEPT th'e east q50 ft. thereof, of
that portion of the following described tract lying
north of the north line of Werner Road; North half
of the SE 1/4 of the NE 1/4; EXCEPT the E 1/4 thereof,

hereby covenants and agrees that the use of said property shall
be restricted in the following particulars, namely:
1. That the property shall be conditionally rezoned to R-~ and B, 2 for the
purpose of allowing the undersigned to pursue an application for
federally subsidized housing under Section 235 or a Turn Key
project: of the Federal Housing Act of 1965 as amended.
2. That the final plans approved by F.H.A. shall be subject to
review and/or modification by the Planning Commission and the
City Council of the City of Bremerton.
3. That the conditional zoning from R-1 to R-2 and B-2 shall continue
in effect for a period not to exceed 18 months. If at the end of
that period, substantial progress has not been made toward the
completion of the project, the Planning Commission shall initiate
a petition to rezone the property to its present R-1 status.
That the restrictions and obligations herein imposed are for The
benefit of the City of Bremerton, a Municipal CorporaTion~ and
for all The property owners adjacent to said property herein above
described and lying within 250 feet of th~ boundaries of the
same and may be enforced by said parties as covenants running
with the land. In the event the developer or its assigns shall
hereaftep at any time violate any of the covenants, restPictions
or obligations of this agreemenT~ and the City places The matter
in The hands of an attorney for enforcement~ The developer and
or its assigns shall be liable and agpee to pay to The City of
Bremer%on~ a measonable attorney's fee plus actual costs expended
in enforcing The covenants, restrictions and obligations of This
agreement, These covenants shall be binding upon the said
owneps, their heirs, executors, successors and assigns.
