certain real property lying along the southern shore-
line of Kitsap Lake for the purpose of a City Park,
directing condemnation of property for such purpose
and the payment of just compensation therefor; and
declaring an emergency.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. That for the public health, safety and welfare
of the citizens of the City of Bremerton, said City has entered into
a program to develop a City Park and has caused to be prepared general
and specific plans therefor.
Section 2. To accomplish the said development, it is
necessary to secure property for the development of the said Park
through and over the following described real properties:
PARCEL 1
That portion of the SW 1/4 of the SE 1/4 of Section 17,
Township 24 North, Range 1 East, W.M. described as
follows:/ Beginning at the northeast corner of south
497 feet of said SW 1/4 of the SE 1/4; thence North
88°11'11'' west along the north line thereof, a distance
of 469 feet to a point on the northerly margin of
County Road No. 250; thence North 40o26'26'' east along
said northerly margin 379.88 feet; thence North 58°03'
34" west 170 feet to the true point of beginning; thence
South 31°$6'26'' west 40 feet; thence South 58°03'34''
east 70 feet; thence North 31°56'26'' East 10 feet;
thence South 58°03'34'' east 95.51 feet, more or less, to
said northerly margin of County Road No. 250; thence
South 40o26'26'' west, along said northerly margin, 196.04
feet; thence North 60°03'23'' west to high water line of
Kitsap Lake; thence northeasterly along said high water
line 240 feet, more or less, to a point which is North
58°03'34'' west from point of beginning; thence South
58°03'34'' east to point of beginning; Also that portion
of the SW 1/4 of the SE 1/4 of Section 17, Township 24
North,. Range 1 East, W.M. lying southeasterly of County
Road No. 250 and northeasterly of the following described
line: Beginning at the northeast corner of South 497
feet of said SW 1/4 of the SE 1/4, thence North 89°22'59''
West, along the North line of said South 497 feet, 394.24
feet to easterly margin of County Road No. 250; thence
North 39°14'38'' east along said margin 308.77 feet to
true point of beginning of this description; thence
leaving said road margin and running South 51°43'29'' east
261.46 feet to east line of said SW 1/4 of the SE 1/4 and
the terminus of said line description; situate in Kitsap
County, Washington.

PARCEL 2
That portion of the SW 1/4 of the SE 1/4 of Section 17,
Township 24 North, Range 1 East, W.M. described as
follows: Beginning at the northeast corner of the South
497 feet of said SW 1/4 of the SE 1/4; thence North
89°22'59'' west along the north line thereof, 469.00 feet
to a point on the northerly margin of County Road No. 250;
thence North 39°14'38'' east along said margin 153.51 feet
to the true point of beginning; thence South 39°14'38''
west 153.51 feet; thence leaving said road margin run
North 89°22'59'' west along north line of south 497 feet of
said SW 1/4 of the SE 1/4, 838.33 feet to the northwest
corner thereof; thence North l°20'53'' east along the west
line of said SW 1/4 of the SE 1/4, 155.40 feet, more or
less, to high water line of Kitsap Lake; thence north-
easterly along said high water line 610 feet, more or less,
to a point on a line running North 60°03'23'' west from the
true point of beginning; thence leaving said high water line
run South 60o03'23'' east 190 feet, more or less, to an iron
pipe; thence continuing South 60°03'23'' east 177.15 feet to
true point of beginning; EXCEPT 10 foot wide easement for
pipe line as granted by instrument recorded under Auditor's
File No. 18764; AND EXCEPT an easement for access to Kitsap
Lake over and across a 10 foot strip along the northeasterly
line thereof; AND EXCEPT the surface water rights to an
unnamed stream as per Auditor's File No. 320200.
PARCEL 3
That portion of the South 497 feet of the SW 1/4 of the SE
1/4 of Section 17, Township 24 North, Range 1 East, W.M.
lying west of County Road No. 250; EXCEPT right of way t0
feet wide running diagonally across said land northwesterly
for pipe line ($ feet on each side of pipe line) where pipe
line is now located to dam in the southeast corner of above
land for supplying water to: Part of the SW 1/4 of the SE
1/4, Section 17, Township 24 North, Range 1 East, south of
a line parallel to and 1039.80 feet north of the south
boundary of the SW 1/4 of the SE 1/4 and north boundary of
above land, also EXCEPT real estate upon which the dam is
located.
PARCEL 4
That portion of the South 618 feet of the SE 1/4 of the SW
1/4, Section 17, Township 24 North, Range 1 East, W.M. lying
east of the County Road, situate in Kitsap County, Washington.
Section 3. The City Attorney is hereby authorized and
directed to proceed immediately with the condemnation for the above
described properties in the Superior Court of the State of Washington
for Kitsap County.
Section 4. That an emergency exists and is hereby declared
to exist, and this Ordinance is necessary for the immediate preservation
of the public peace, health and safety of the citizens of the City of

Bremerton and this Ordinance should take and be effective i~ediately
following passage and publication.
PASSED unanimously by the City Council of the City of
Bremerton, signed by the Mayor and attested.by the City Clerk in
authentication of such passage this ~ay of September, 1970.
