AN ORDINANCE repealing Paragraph 4,
Section 505 and Paragraph 4, Section
511, of Ordinance No. 1792, as amended
by Ordinance No. 2297.
wHEREAs, present ordinance requirements of Ordinance
No. 1792, .a,~,~amended by Ordinance No. 2297, requiring a
maximum number of employees on the premises at one given
time do~. not specifically relate to the police power or
protection of the public health, safety and general welfare,
and
WHEREAS, other requirements and restrictions of
said ordinances listed under each of the two districts,
B-1 and B-2 are sufficient to limit uses in the districts,
and
WHEREAS, the paragraphs in question are discrimina-
tory and thus unconstitutional in that some uses are allowed
a specific number of employees while other uses are limited
to a lesser number of employees. No firm reasoning related
to the police power can be established for this preferential
selection~ now, therefore,
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. That Paragraph 4, Section 505 and
Paragraph 4, Section 511, of Ordinance No. 1792, as
amended by Ordinance No. 2297, are hereby repealed.
