AN ORDINANCE amending the use and
area maps according to Ordinance
No. 1792
THE CITY OF BREMERTON DOES ORDAIN:
SECTION 1. That the use and area maps of
Ordinance No. 1792, be and they hereby are, amended in
conformity with Title IV, Chapter 1 thereof as follows:
All of Tracts 12 and 13, Plat of Moudy's
Subdivision, according to records of Kitsap
County Auditor; Kitsap County, Washington.
be and the same hereby is reclassified from Residential-One
(R-l) to Residential-Two (R-2), subject to the site plan and
Land Use Restrictions, attached hereto and made a part hereof
by this reference.
APPROVED by the City Council on the first reading

PASSED by the City Council of the City of Bremerton,
signed by the Mayor and attested by the City 'Clerk in

DECLARATION OF LAND USE RESTRICTIONS
F. A. ABILLE, as the c~ner of the follo~ing described property, for the
consideration of the rezoning of said property from Residential-One (R-i), Single
Family and Duplex District, to a Residential-Two (R-2), Malti-Family District,
does hereby covenant and agree that the land of the real property situated in
the City of Bremerton, County of Kitsap, Washington described as follows.'
Ail of Tracts 12 and 13, Plat of Moudy's Subdivision, according to
records of Kitsap County Auditor; Kitsap County, Washington
shall be restricted to the following particulars, namely:
1. That the development of said ~roperty shall be essentially the same as
the site plan, a copy of which is attached hereto and dated.
2. That set back from 13th Street is to be 50 feet.
3. Henry Avenue is not to be used for access~ exzept fmr
4. Existing vegetation on the property lines is to be retained.

T~at the restrictions and obligations herein imposed are for the benefit
of the City of ~remerton, a municipal corporation, and for a~l the property owners
adjacent to said property hereinabove described and lyi~__g within 250 feet of the
boundaries of the same and may be enforced by said parties as covenants running
wi~h the land. These covenants shall be bindi~ upon the said o~ners, their heirs,
executors, successors and assigns.
In the event that the City or an adjoining landowner x~ithin 250 feet of the
property commence suit to enforce any of the above covenants and agreement and
relief is granted substantially in accordance with the claim, the developers agree
to pay all cost incurred and a reasonable sum for attorney's fees.
