1308.4 and 1308.5.
THE CITY OF BREMERTON
SECTION 1: That Section 1300 in Title V Chapter 1 of
Ordinance No. 1792 is amended to read as follows:
Section 1300: In interpreting and applying the provisions of
this ordinance they shall be held to be the minimum requirements
for the promotion of the public health, safety, morals and general
welfare; therefore, where this ordinance imposes a greater restriction
upon the use of the buildings or premises, or upon the height
of buildings, or requires larger open spaces than are imposed or
required by other laws, ordinances, rules or regulations, the pro-
visions of this ordinance shall control, except as provided-by this
chapter.
SECTION 2: New sections are added to Ordinance 1792 as
follows:
Section 1308.4 Variances. The Planning Commission may approve
or disapprove applications for variances, or appeals from approval
or disapproval of administrative variances, not amounting to rezones.
Section 1308.5 Requirements for variance: Before the Planning
Commission may approve a variance as provided by this chapter it must
be shown that:
(a) special circumstances, including but not limited to,
shape, topography, location or surroundings, are applicable to the
subject property or intended use;
(b) the variance is necessary for the preservation and
enjoyment of a substantial property right or use which is denied to
the property in question;
(c) such variance will not be materially detrimental to
the public welfare or injurious to property rights in the vicinity
where the property is located; and ~
(d) the granting of the variance is not adverse to the
COMPREHENSIVEPLAN.,
