new Section No. 1308; providing for Administrative
Variances from the requirements of Ordinance No. 1792,
in RESIDENTIAL-ONE and RESIDENTIAL-TWO DISTRICTS;
appointing an. Administrator; and affirming the right
to an appeal;
~ THE CITY OF BREMERTON DOES ORDAIN:
~ Section 1. Ordinance No. 1792 is hereby amended by the addition of
new sectio~ to Title V, to read as follows:
"Section 1308.1 Variances. An Administrative Variance Official, the City
Planning Director, shall review and approve or disapprove of applications
for Variances, not amounting to rezones, from the requirements of this ord-
inance, in R-1 and R-2 Districts. The following provisions shall be subject
to Administrative Variances: Parking Requirements, Front Yards, Rear Yards,
Side Yards, Fence Heights and Lot Coverage."
"Section 1308.2 Required Showings for an Administrative Variance:
Before an application for a variance may be approved, it shall be shown:
(a) That special circumstances are applicable to the subject property or
intended use, such as: shelve, topog~$~V, location, or surroundir~s;
a substantial pro~r~y ri~t or u~% ~i~ ~cause of ~l~cial
eircumetance is denied to the p~operty i~ q~ee%ion;
(c) That the granting of such variance will not be materially detrimental
to the public welfare, injurious to the property or improvements in
the vicinity and zone in which the property is located;
(d) That the granting of such variance will not adversely affect the
Comprehensive Plan;
(e) That the adjoining property owners do not object to the proposed variance."
"Section 1308.3 Right of a Hearing Before the Planning Commission.
The right of a hearing and appeal to the Planning Commission shall remain to
any aggrieved party who wishes to object to the denial or approval of an
Administrative Variance in writing to the Secretary of the Planning Commission."
