certain real property for the purpose of
improvement of the intersection at Wheaton
Way and Sylvan Way; and declaring an
emergency.
THE CITY OF BREMERTON DOES ORDAIN:
SECTION 1. That for the public health, safety and welfare
of the citizens of the City of Bremerton, said city has entered into
a program to improve the intersection at Wheaton Way and Sylvan Way
and has caused to be prepared general and specific plans therefor.
SECTION 2. To accomplish the said intersection improve-
ment, it is necessary to secure construction easements and a per-
manent right of way over, across, along, through and under the
following described pieces of real property:
The north 52.35 feet of the west 225 feet of Tract
7; and the west half of Tract 8; EXCEPT the east
100 feet thereof~ all in Sylvan Park, according
to plat recorded in Volume 6 of Plats, Page 45, in
Kitsap County, Washington.
AND
the west 225 feet of Tract 7, Sylvan Park, according
to Plat recorded in Volume 6 of Plats, Page 45, in
Kitsap County, Washington; EXCEPT the north 52.35 feet.
Said right of way to be acquired on a strip of the above described
property described as follows:
That portion of Lots 7 and 8, Sylvan Park, according
to Plat recorded in Vol. 6 of Plats, Page 45, Kitsap
County, Washington lying west of the following described
line:
Beginning at the SW Corner of Lot 7 of said Plat~ thence
east along the south line thereof 6 feet to the TPOB~
thence north parallel to and 6 feet east of the west
line of said Lot 7, to a point 2.25 feet south of the
north line of said Lot 7; thence northeasterly to a
point 99.91 feet south and 16 feet east of the NW
Corner of said Lot 8; thence north 82.91 feet; thence
along the arc of a curve to the right said curve having
a radius of 17 feet a distance of 26.70 feet to its
intersection with the north line of said Lot 8 and the
end of this description.
Said construction (temporary) easement is to include a strip
through the above-described property described as follows:
Construction Easement needed:
The west 30 feet and the north 5 feet of Tract 8,
Sylvan Park, according to plat recorded in Vol. 6
of Plats, Page 45, Kitsap County, Washington.
AND
The east 6 feet of the west 12 feet of the north
52.35 feet of Tract 7, Sylvan Park according to Plat
recorded in Vol. 6 of Plats, Page 45, Kitsap County,
Washington.
The east 5 feet of the'~st 11 feet of the south
107.65 feet of the wes%'i225 feet of Tract 7, Sylvan
Park according to Pla~corded in Vol. 6 of Plats,
Page 45, Kitsap County~ ~Washington.
SECTION 3. The City A~°rney is hereby authorized and
directed to proceed immediately wiith the condemnation for the
above described property in the S~erior Court of the State of
Washington for Kitsap County.
SECTION 4. That an emergency exists and is hereby de-
clared to exist, and this Ordinance is necessary for the immediate
preservation of the public peace, health and safety of the citizens
of the City of Bremerton and this Ordinance should take and be
effective immediately following passage and publication.
PASSED unanimously by the City Council of the City of
Bremerton, signed by the Mayor and attested by the City Clerk in
authentication of such passage this ' day of July, 1976.
