HomeMy WebLinkAbout3302 ORDINANCE NO. -~~~__ AN ORDINANCE declaring the need for condemnation of a strap of land in and through certain real'property for the purpose of constructing, installing, operating, replacing, repairing, main- taining and reconstructing, a water transmission pipeline; and declaring an emergency. (Wilson, Mischel & YanS]ten) THE CITY OF BREMERTON DOES ORDAIN: SECTION 1. That for the public health, safety and welfare of the citizens of the City of Bremerton, said City has entered into a program to construct, install, maintain, and operate a water trans- mission pipeline and has caused to be prepared general and specific plans therefor. SECTION 2. To accomplish the said construction, installa- tion, maintenance and operation of a water transmission pipeline it is necessary to secure construction and permanent easements over, across, along, through and under the following described pieces of real property: PARCEL A. (Permanent Easement: ) A permanent easement of a strip of land 15' in width lying East and South of the following described easement boundary line; beginning at the SW corner of Sec. 20 TWN 24 R1E, thence North 1°33'55'' East along the West line of said Sec. 20 1326.16' to the SW corner of the NWl/4 of the SW1/4 of said Sec. 20 and the TPOB, thence continuing North 1°33'55'' East along the West line of said Sec. 20 954.34', thence North 25°57'10'' East 1884.89' to the North line of the SW1/4 of the NWl/4 of said Sec. 20, thence South 88°36'17'' East 516.92' along said North line to the NE corner of said SW1/4 of the NWl/4 of said Sec. 20 TWN 24 R1E, W.M., Kitsap County, Washington, in and upon which to lay, operate and maintain water pipes, together with any necessary appurtenances within said easement. (Construction (temporary) Easement:) A construction (temporary) easement of the 20' easterly and southerly and adjacent to a strip of land 15' in width lying East and South of the following described easement boundary line; beginning at the SW corner of Sec. 20 TWN 24 R1E, thence North 1°33'55~ East along the West line of said Sec. 20 1326.16' to the SW corner of the NWl/4 of the SW1/4 of said Sec. 20 and to the TPOB, thence continuing North 1°33'55'' East along the West line of said Sec. 20 954.34', thence North 25°57'10'' East 1884.89' to the North line of the SW1/4 of the NWl/4 of said Sec. 20, thence South 88°36'17'' East 516.92' along said North line to the NE corner of said SW1/4 of the NWl/4 of said Sec. 20 TWN 24 R1E, W.M., Kitsap County, Washington, in and upon which to lay, operate and maintain water pipes, together with any necessary appurtenances within said easement. PARCEL B. (Permanent Easement:) A permanent easement on the North 15' of the West 1070' of the Southeast 1/4, Northwest 1/4, Section 20 Township 24 North, Range 1 East, W.M., Kitsap County, Washington, in and upon which to lay, operate and maintain water pipes, together with any necessary appurtenances within said easement. (Construction (temporary)~ Easement:) A construction (temporary) easement of the 20' Southerly and adjacent to the permanent easement on the North 15' of the West 1070' of the South- east 1/4, Northwest 1/4, Section 20, Township 24 North, Range 1 East, W.M., Kitsap County, Washington, in and upon which to lay, operate and maintain water pipes, together with any necessary appurtenances within said easement. PARCEL C. (Permanent Easement:) A permanent easement of a strip of land 15' in width lying adjacent to the east margin of an existing driveway, the centerline of said driveway being the west property line of a parcel of property conveyed to Myrtle A. Harris Wilson A/K/A Almeda Harris filed under Auditor's file #1092101, situated in the SE 1/4 of the NE 1/4 of the NW 1/4 of the SW 1/4 of the NW 1/4 of the NE 1/4, Section 20, Township 24, Range 1 East, W.M., Kitsap County, Washington, in and upon which to lay, operate and maintain water pipes~ together with any necessary appurtenances within said easement. (Construction (temporary) Easement:) A construction (temporary) easement of the 20' easterly and adjacent to a strip of land 15' in width lying adjacent to the east margin of an existing driveway, the centerline of said driveway being the west property line of a parcel of property conveyed to Myrtle A. Harris Wilson A/K/A Almeda Harris filed under Auditor's file #1092101, situated in the SE 1/4 of the NE 1/4 of the NW 1/4 of the SW 1/4 of the NW 1/4 of the NE 1/4, Section 20, Township 24, Range 1 East, W.M., Kitsap County, Washington, in and upon which to lay~ operate and maintain water p±pes~ together with any necessary appurtenances within said easement, ~ '~ I 2 - SECTION 3. The City Attorney is hereby authorized and directed to proceed immediately with the condemnation for the above described property in the Superior Court of the State of Washington for Kitsap County. SECTION 4. That an emergency exists and is hereby declared to exist, and this Ordinance is necessary for the immediate preservation of the public peace, health and safety of the citizens of the City of Bremerton and this Ordinance should take and be effective immediately following passage and publication. PASSED unanimously on first reading by the City Council of the City of Bremerton, signed by the Mayor and attested by the City Clerk in authentication of such passage this _~6) ~day of June, 1976.
