~ AN ORDINANCE vacating right-of-way on that
portion of the alley abutting Lots 1 through
'~ 3 and Lots 14 through 16, Block 1, Lucy Smith's

~ THE CITY OF BREMERTON DOES ORDAIN:
SECTION 1. That there has been, previously filed with
the City Council, a Petition requesting vacation of right-of-way of
that portion of the alley, described more particularly below; that
a hearing was had on said petition on the 7th day of September, 1977,
after notice had been posted and given in the manner provided by law;
that at said hearing the City Council approved said Petition with
conditions.
SECTION 2. That the land described as:
That portion of the alley abutting Lots 1
through 3 and Lots 14 through 16, Block 1,
Lucy Smith's First Addition, City of Bremerton,
Situate in Kitsap County;
be and hereby is declared vacated, provided that easements for public
utilities, including sewer and water lines, telephone and power cables
now on or under the surface of ~he area vacated, are hereby retained
by the City of Bremerton and the right to grant easements, in respect
to the areas hereby vacated, for the construction, repair and mainte-
nance of public utilties and services is also retained by the City of
Bremerton. It is provided further, that the alley should remain open
to vehicular and pedestrian traffic so long as the City of Bremerton
deems it proper and there will be no signs erected by the Owner of the
property or his agents, assignees or subsequent Owners of the property
that indicate that the alley is not a public roadway.
