connections to buildings without
Certificates of Occupancy.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BREMERTON:
SECTION 1. Definitions. For the purpose of this
ordinance, the words and terms shall have the same meanin9 as each
has under the Uniform Buildin9 Code, 1976 Edition, as published by
the International Conference of Buildin9 Officials and adopted by
Ordinance No. 3438 unless otherwise specifically provided herein,
or the context in which they are used clearly indicates that they
have other meaning.
SECTION 2. (a) New Buildings. No new buildin9 or
occupants thereof shall be permitted to make permanent connection,
nor shall any utility make such permanent connectionf to any utility,
except as noted herein, until there has been a Certificate of
Occupancy issued for said buildin9 by the Buildin9 Official.
(b) Changed Occupancy Classification. No existing building
with changed occupancy classifications, or occupants thereof, shall
be permitted to make permanent connection, nor shall any utility
make such permanent connection~ to any utility, except as noted
herein, until there has been a Certificate of Occupancy issued for
said building by the Buildin9 Official.
(c) Sanitary Sewer Excepted. Sanitary sewer connections
are excepted from this ordinance when such connection must be made
durin9 constructi0n~ or when such connection exists and is in
compliance with existing standards.
SECTION 3. Prohibited Utility Connections. No person,
firm or corporation shall knowin9ly apply for or accept utility
service or knowingly permit such application for utility service to
be made to any buildin9 as defined in sections 2(a) and 2(b) of
this ordinance until such time as a Certificate of Occupancy has
been issued by the Buildin9 Official.
SECTION 4. Construction Uti.lity Connections. Nothin9
herein shall be construed to prevent temporary utility connections
during construction of any new buildin9 or construction of any
existing buildin9 with changed occupancy classification· Such

temporary utility connection shall be removed o. shut off once
construction is completed until such time as a Certificate of
Occupancy has been issued for the building by the Building Official.
SECTION 5. Notice Provision. The Building Department
shall provide applicants for a building permit for new construction
or change in occupancy classification a written notice that it is
a misdemeanor to apply for or accept utility service or knowingly
permit such application for utility service to be made to any new
building or existing structure with a changed occupancy classifica-
tion until such time as a Certificate of Occupancy has been issued.
SECTION 6. Water Service Connections. Upon application
for a water service connection to any new building or existing
structure with a changed occupancy classification, the Water
Department shall require such applicant to sign a form stating that
a Certificate of Occupancy has been issued by the Building Inspector
for the building to be served.
SECTION 7. Any person who obtains a utility service
connection in violation of this ordinance is guilty of a misdemeanor
and upon conviction shall be punished by a fine not to exceed five
hundred dollars, together with the costs of such action, or by
imprisonment in the City jail for a period not to exceed sixty
days, or both such fine and imprisonment.
