Retirement System and Disability Pension System
under Ordinance No. 1572 and amending .paragraph (a)
of Section 15 thereof to limit disability retirement
to disability incurred while in city service.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. That paragraph (a) of Section 15 of Ordinance
No. 1572 be amended to read as follows:
Section 15. (a) Any member who has not attained the
age of sixty-two (62) and who has at least ten (10) years of city
service, over a period of not to exceed fifteen (15) years immedi-
ately preceding retirement, may be retired for permanent and total
disability, either ordinary or accidental, occurring while in
city service and not connected with any illness or disability
existing prior to entering city service, upon examination as here-
inafter set forth; provided that city service lost while on previous
.disability retirement shall not be considered in determining if the
applicant has city service in the limits specified.
Any member while in the city ser.vice, or within three (3)
months after the discontinuance of city service, or while physically
or mentally incapacitated for the performance of duty, if such
incapacity has been continuous from discontinuance of city service,
shall be examined by a physician or surgeon, appointed by the Board
of Administration, upon the application of the head of the office
or department in which said member is employed, or upon application
of said member, or a person acting in his behalf, stating that said
member is permanently and totally incapacitated, either physically
or mentally, for the performance of duty and ought to be retired.
If such medical examination shows, to the satisfaction of the
Board, that the said member is permanently and totally incapacitated
either physically or mentally for the performance of duty and ought
to be retired, the Board shall retire the sa~d member for disabil~ty
forthwith.
The provisions of this section shall not be applicable to
employees who have been pensioned for permanent and total disability,
as defined in and pursuant to State law.
