Home My WebLink About2483 AN ORDINANCE relating to and regulating the installation and use of pipes, fixtures, and apparatus used or intended to be used to conduct or consume the natural, manufactured or mixed gas in the City of Bremerton; providing for the qualification of installers permits and fees; repealing Section 2 of Ordinance No. 2236 and amending Ordinance No. 2236 by adding thereto Sections 2.0 through 2.8. THE CITY OF BREMERTON DOES HEREBY ORDAIN: Section 1. That Section 2 of ordinance No. 2236 be and the same is hereby repealed. Section 2. That Ordina~ce No. 2236 is hereby amended by adding thereto Section 2.0 Which~reads _as ~follows: LICENSE REQUIRED: It shall be unlawful for any person, firm or corporation to engage in the business of installing, extending, altering, or repairing any gas piping, fixtures or appliances in the City of Bremerton without first obtaining a Gas Installing Contractor's license pursuant to the terms of this ordinance. Section 3. That Ordinance No. 2236 is hereby amended by adding thereto Section 2.1 which reads as follows: DEFINITIONS: The term "Gas Installing Contractor" shall be construed to mean and include every person engaged in or engaging in the business of furnishing, either ~y contract, subcontract, day labor or otherwise, tony labor or material connected with the business of installing, extending, altering, or repairing any piping, fixtures or appliances in any building or elsewhere intended for the conducting or consumption of natural, manufactured or liquid petroleum gas. The term "Gas Fitter and Appliance Installer" shall be construed to mean any person who actually performs the labor required in installing, extending, altering, or repairing any gas piping, venting, fixtures or appliance and who is the holder of a valid Certificate of Competency issued pursuant to the provisions of this ordinance. Section 4. Ordinance No. 2236 is hereby anmended by adding thereto Section 2.2 which reads as follows: EXPERIENCE REQUIRED: All applicants for Gas Fitter and Appliance Installer's Certificate of Competency shall be familiar with all codes, ordinances, and regulations governing the installation of gas piping, venting, fixtures, and appliances and shall possess one of the following qualifications: 1. Proof of a reasonable amount of experience acquired on installations which have been approved by a recognized authority or a journeyman plumber. 2. Certificate indicating satisfactory completion of a course in gas fitting and appliance installing. The examining board shall determine the sufficiency of the experience and education of the applicant. Section 5. That Ordinance No. 2236 is hereby amended by adding thereto Section 2.3 which reads as follows: CJ~S FITTERS AND APPLIANCE INSTALLER'S EXAMINING BOARD: There is hereby created an examining board for Gas Fitters and Appliance Installer"s consisting of the Plumbing Inspector and the Chief of the Fire Prevention Bureau as ex-officio members who shall not be entitled to a vote; one licensed Gas Installing Contractor; one certificated Gas Fitter and Appliance Installer; one Gas Company Representative; one master plumber and one journeyman plumber. All are to be appointed by the Commissioner of Public Works and Utilities with the approval of the City Council. They shall serve without compensation. The term of office of each shall be four years provided, however, in the appointing of the first board the Gas Installing Contractor and journeyman plumber shall be appointed to two year periods. Thereafter, their terms shall be four years. Said board shall select its own chairman and a majority of the members shall constitute a quorum. The plumbing inspector shall serve as Secretary to the board. Section 6. That Ordinance No. 2236 is hereby amended by adding thereto Section 2.4 which reads as follows: EXAMINATIONS: It shall be unlawful for any person to engage in or work as a Gas Fitter and Appliance Installer either as a journey- man or as a licensed Gas Installing Contractor, working in the capacity of a Gas Fitter and Appliance Installer or to install, extend, alter or repair any gas piping, venting fixture or appliance in any building or elsewhere without first making application to the Examining Board hereinabove provided for and at such time and place as said board may designate, submitting to and passing such examination as to his quali- fications and competency as a Gas Fitter and Appliance Installer. The examination shall be of such character, both practical and theoretical, as to thoroughly test the applicant's ability and competency as a Gas Fitter and Appliance Installer. The Examining Board shall conduct examinations from time to time, but no applicant shall be compelled to wait more than sixty days following his application. Said Board shall examine such applicant as to his knowledge of gas piping, installation and venting of fixtures and appliances, necessary safety controls, and t~e over all safety precautions necessary in the installation of gas. The Board, if satisfied with t~he ~c~.mpetency of such applicant, shall thereupon authorize the City ~ to issue to the applicant a Gas Fitter's and Appliance Installer's Certificate of Competency authorizing him to engage in the work of installing, extending, altering, or repairing gas piping, venting fixtures or appliances as an artisan or journeyman gas fitter and appliance installer. Temporary working permits may be issued to an applicant by the Plumbing Inspector until such time as the Examining Board meeting and the examination can be completed. The Board shall keep and preserve a record of all persons examined by them and to w~,~uch certificates of Competency have been issued. A fee of F~4~'~Dollars shall be charged each person making application for examination. Section 7. That Ordinance No. 2236 is hereby amended by adding thereto Section 2.5 which reads as follows: EXEMPTIONS: .The Gas Installers License or a Gas Fitter and Appliance Installer's Certificate of Competency shall not be required of those persons, firms, or corporations engaged exclusively in the laying of gas mains in the public streets or alleys and running service to a meter within a building or other place. Section 8. That Ordinance No. 2236 is hereby amended by adding thereto Section 2.6 which reads as follows: LICENSE FEE: The license fee for a Gas Installing Contractor shall be and is hereby fixed in the sum of ~'~" dollars per annum, payable in advance for each establishment or place of business. The fee for__.~a Gas Fitter's Certificate of Competency is and shall be fixed at ~ dollars per annum. Section 9. That ordinance No. 2236 is hereby amended by adding thereto Section 2.7 which reads as follows: REVOCATION OF LICENSE: Any Gas Installing Contractor's License or any Gas Fitter's Certificate of Competency may be revoked for cause by the Commissioner of Public Works and Utilities, by notice to said licensee in writing by registered mail of the suspension or revocation. Any licensee may, within ten days of receipt of such notice of suspension or revocation appeal to the City Council by filing a written notice of appeal, setting forth grounds therefor, with the City Clerk, and the City Council shall set a date for the hearing of such appeal. And the City Clerk shall notify the licensee of the time and place of the hearing. After the hearing thereon the City Council may affirm and modify or overrule the suspension or revocation and reinstate,_,~ ,;$~' ~,~ ~ the license, and may impose' any terms upon the continuance of the~hi~h to the City Council may seem advisable. The suspension or revocation shall be stayed pending final action by the City Council. Section 10.
