THE CITY OF BRE~ERTON DOE~ ORDAIN: ~eotion 1. That the Alley located in Block 5 of Dietz~s Addition be improved bv the ~onstr~ction of d~ainage struotues, sewer connections, base course and bituminous paving, together with the doing of anv and all work in connection the~e- with as may be necessary to make such improvement a complete job, all in accordance with the maps, plans and specifications now on file in the office of t~e City Engineer of the CitV of Bremerton. Section 2. That the maps, plans and specifications prepared bv the CitV Engineer, now on file in the office of said GitV Engineer, for the aforesaid improvement be and the same a~e he~ebV adopted. Section 3. That the cost and expense of said improvement shall be borne by and assessed against the p~opertV included in the assessment district hereinafter created, in accordance with the p~ovisions of the Revised Code of Washington 35,N3,080 except ~uoh proportion of said cost as shall be bo~ne bv and paid for by the State of Washington or other governmental agency, which proportion of such cost and expense is hereby declared to be in accordance with the special be~efit~ confe~rad upon such property. Section N. That there is hereby established and created a local improvement ~istrict to be calle~ and known as: Local Impr..ov~ment Distrio.~ ~o~ 2~N 'the boundaries of which a~s described as follows: Beginning at the point of intersection of the south margin of 9th Street with the east margin of Chester Avenue~ thence south along the east ma~gin of Chester Avenue to the cente~line of the alley running east and west in Block 5 of Dietz's Addition; thence continuing south along said east ma~gin of Chester Avenue ~2,50 feet~ thence east NO.ON feet ~/L; thence south to the no~th margin of 8th Street; thence east ORDINANCE NO. along the north margin of 8th Street to the west margin of Broadway Au :e; the~ north along the west margin of 8roedway Avenue to the northeast corner of Lot 22 of maid plat; thence west 64.00 feet; thence north to the south margin of gth Street; thence west along the mouth margin of gth Street to the point,of beginning. Section 5o That the comt and expense of said improvement to be borne by said improvement district and~lumive of any portion borne by either the State of Washington or other governmental agency mhall be amsessed against said property included in said Improvement Dimtrict in accordance with the special benefitm it will derive from the improvement without regard to the zone and termini method, and in accordance with the provisions of the Revimed ~ode=of Washington 35.43.080 and the remainder of said cost ~f the improvement to'be paid for by arrangement, if any, with the State of Washington or othsr governmental agency. Section 6. That bondm, warrants or installment notes bearing interest at rate of not more than six percent per annum, payable on or before 10 veers f~om th~ date of immuance, shall be immued in payment of the cost and expenme of said improvement am'mesmed against the property included in the district hsreinabove demcribed which bonds, warrantm or inmtallment notem mhall be redeemed by a collection of special asmemsment levied and asmemsed against the propertV within maid dimtrict, payable in equal annual installments, with interest at the rate of not to exceed eight percent per annum under the mode of payment bV bonds, warrants or inmtallment notes as required'by law and the ordinances of the City of Bremerton. Theme bonds, warrants or inmtallment notes shall be delivered to the contractor in redemption of warrants on the Local Improvement Dimtriot fundm ismued on the estimate of the GitV ~ngineer, or the City of Bremerton may, at its option, sell said bonds, warrentm or in~tallment~ootes and make much redemption in camh. Section ?. That this Ordinance mhall take effect immediately following passage and publication, a~ provided bv law.
