AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF:
Rickey Road (Sheridan Road to North line of Section 11,
T.24N., R.1E., W.M.), Pine Road (Sheridan Road to North
line of Section 1!, T.24N., R.,,1E., W.M.), East 30th
(Rickey Road to West line of N.E. 1/4 of N.W. 1/4~
Section 11, T.24N., R.1E., W.M.), Sheridan Road (Pine
Road to Rickey Road.), East 31st (Rickey Road to Pine Road)
all in accordance with the plans, maps, and specifications on file
in the office of the City En~ineeu~ adoptin~ said plans, maps and
specifications~ establishin~ an improvement district~ providin~ for
The levyin~ of assessments for the payment of such improvement and
makin~ such improvement payable by bonds.warrants~ and installment notes.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. That Rickey Road, Pine Road, Sheridan Road, East 31st
and East 30th shall be improved by The construction of a sanitary
sewe~ trunk line and side laterals within the street right of way,
to~ether with the doin~ of any and all work in connection therewith
as may be necessary to make such improvement a complete job~ all in
accordance with The maps, plans and specifications now on file in
the office of the City En~inee~ of the City of Bremerton.
Section 2. That the maps, plans and specifications prepared
by the City Engineer, now on file in the office of said City EnEineer,
for the aforesaid improvement be and the same are hereby adopted.
Section 3'. That the cost and expense of said improvement shall
be borne by and assessed azainst the property included in the
assessment district hereinafter created, in accordance with The
pmovisions of the Revised Code of Washington 35.43.080 except such
proportion of said cost as shall be borne by and paid for by the
State of Washington or other ~overnmental aKency, which,proportion
of such cost and expense is hereby declared to be in accordance
wi~h the special benefits conferred upon such property.
Section l~. That there is hereby established and created a local
improvement district to be called and known as:
Local Improvement District No. 298
the boundaries of which are described as follows:
Beginning at the centerline of Pine Road and its inter-
section with the North line of Section 11, T24N, R1E,
W.M.; thence West along the North line of said Section 11
to the center!ine of Rickey Roads thence continuing West
along the North line of said Section 11, 156 feet~ thence
Southerly and parallel to the centerline of Rickey Road
a distance of 168.13 feet; thence Westerly and parallel
to the centerline of East 30th Street to the West line of
the NE 1/4 of the NW 1/4 of Section 1!, T24N, R1E, W.M.;
thence Southerly along the West line of said NE 1/4 of NW 1/4 a
distance of 330.00 feet; thence Easterly and parallel to
the centerline of East 30th Street a distance of 126.00
feet; thence Northerly and parallel to the West line of
the NE 1/4 of the NW 1/4 of said Section 11, a distance
of 30.0 feet; thence Easterly and parallel to the center
line of East 30th Street to the center line of Rickey
Road; thence Southerly along the center line of Rickey
Road a distance of 780 feet; thence N 89°36'00'' W a
distance of 109.44 feet; thence S 0°24'00'' W a distance
of 60 feet; thence S 89°36'00'' E and Easterly along the
center line of Sheridan Road to a point which is 150
feet East of the center line of Pine Road~ thence
Northerly along a line which is 120 feet East of and
parallel with the center line of Pine Road to the North
line of Lot 12 of the Plat of Manette Villa; thence
Westerly along said North line of Lot 2 to the center
line of Pine Road; thence Southerly along the center
line of Pine Road to the point of beginning; EXCEPT the
following described property:
Commencing at the 1/4 Section corner common to Sections 2
and 11, T24N, R1E, W.M.; thence N 89°17'44'' W along the
North line of said SeCtion 11, a distance of 331.88 feet
to the NE corner of the W 1/2 N 1/2 NE 1/4 NE 1/4 NW 1/4~
thence S 0~03'08'' W along the East line of said subdivi-
sion 287.91 feet to the true point of beginning; thence
N 87~17'47'' W a distance of 72.08 feet~ thence S 84°51'
43" W to a point which is 150 feet East of the center
line of Rickey Road; thence Southerly along a line which
is 150 feet East of and parallel with the center line of
Rickey Road to a point which 150 feet North of the center
line of Sheridan Road; thence Easterly along a line which
is 150 feet North of and parallel with the center line
of Sheridan Road to a point which is 120 feet West of
the center line of Pine Road; thence Northerly parallel
to the center line of Pine Road a distance of 166.30
· feet; thence Easterly at right angles to Pine Road a
distance of 5 feet; thence Nbrtherly parallel with the
center line of Pine Road a distance of 108.9 feets thence
Easterly at right angles to Pine Road to the center line
of Pine Road; thence Northerly along the center line of
Pine Road 20 feet~ thence Westerly at right angles to
Pine Road a distance of 150 feet~ thence Northerly alon~
a line which is 150 feet West of and parallel to the
center line of Pine Road to the South line of the E 1/2
N 1/2 NE 1/4 NE 1/4 NW 1/4 of said Section 11; thence
Westerly along said South line to the Southwest corner
of said E 1/2 N 1/2 NE 1/4 NE 1/4 NW 1/4; thence Northerly
along the East line of E 1/2 N 1/2 NE 1/4 NE 1/4 NW 1/4
to the True Point of Beginning and the end of this description.
Section 5. That the cost and expense of said improvement to
be borne by said improvement district and exclusive of any portion
borne by either the State of Washington or other governmental agency
shall be assessed against said property included in said Improvement
District in proportion to said area, except certain units wherein
the special benefits conferred upon the property are not fairly
reflected by the use of the termini and zone method, the assessment
shall be made against the property of the district in accordance
with the special benefits it will derive from the improvement without
regard to the zone and termini method, and in accordance with the
provisions of the Revised Code of Washington 35.43.080 and the
remainder of said cost of the improvement to be paid for by arrangement,
if any, with the State of Washington or other governmental agency.
Section 6. That bonds bearing interest at a rate of not more
than six per cent per annum, payable on or before 12 years from the
date of issuance, shall be issued in payment of the cost and expense
of said improvement assessed against the property included in the
district hereinabove described which bonds shall be redeemed by a
collection of special assessment levied and assessed against the
property within said district, payable in equal annual installments,
with interest at the rate of not to exceed eight per cent per annum
under the mode of payment by bonds as required by law and the ordinances
of the City of Bremerton. These bonds shall be delivered to the
contractor in redemption of warrants on the Local Improvement District
funds issued on the estimate of the City Engineer, or the City of
Bremerton may, at its option, sell said bonds and make such redemption
in cash.
Section 7. That ~is Ordinance shall take effect immediately
following its passage and publication, as provided by law.
PASSED by the City Council of the City of Bremerton, signed by
the MayOr and attested by the City Clerk in authentication thereof
