Section 5. That the cost and expense of said improvement to be
borne by said improvement district and exclusive of any portion borne by
either the State of Washington or other governmental agency shall be
assessed against said property included in said Improvement District in
proportion to said area, except certain units wherein the special benefits
conferred upon the property are not fairly reflected by the use of the
termini and zone method, the assessment shall be made against the property
of the district in accordance with the special benefits it will derive
from the improvement without regard to the zone and termini method, and
in accordance with the provisions of the Revised Code of Washington 35.43.080
and the remainder of said cost of the improvement to be paid for by arrangement,
if any, with the State of Washington or other governmental agency.
Section 6. That bonds, warrants or installment notes, bearing
interest at 'a rate of not more than six percent per annum, payable on or before
10 years from the date of issuance, shall ~be issued in payment of the cost
and expense of said improvement assessed against the property included in
the district hereinabove described which bonds, warrants or installment notes
shall be redeemed by a collection of special assessment levied and assessed
against the property within said district, .payable in equal annual install-
ments, with interest at the rate of not to exceed eight percent per annum
under the mode of payment by bonds, warrants or installment notes as required
by law and the ordinances of the City of Bremerton. These bonds, warrants,
or installment notes shall be delivered to the contractor in redemption of
warrants on the Local Improvement District funds issued on the estimate of the
City Engineer, or the City of Bremerton may, at its option, sell said bonds,
warrants or installment notes and make such redemption in cash.
Section 7. That this Ordinance shall take effect immediately
following its passage and publication, as provided by law.
