AN ORDINANCE amending Ordinance #1560, §8 and adding
a section setting forth appeal rights for persons
denied a fumigator's license.
THE CITY COUNCIL OF THE CITY OF BREMERTON DOES HEREBY ORDAIN:
SECTION 1: Ordinance No. 1560, §8 is hereby amended to read
as follows:
SECTION 8: For any failure to comply with the
provisions of this Chapter, any fumigator's license and any
certificate of fitness may be revoked by the health officer upon
written notice of the reasons for revocation and of the
licensee's appeal rights. Such notice shall be mailed or
delivered to the licensee at his last known address. Such
revocation order shall take effect fourteen (14) calendar days
from delivery unless a written notice of appeal is filed in its
Office of Hearing Examiner within that fourteen (14) day period.
SECTION 2: Ordinance No. 1560 is amended to add the
following section:
SECTION : RIGHT OF APPEAL - Any person denied a
fumigator's license or whose license has been revoked by the
health officer may appeal such an administrative action, in
writing, to the Office of the Hearing Examiner within fourteen
(14) calendar days from the time notice of the health officer's
decision to deny or revoke is given. Any hearing before an
examiner shall be conducted in accordance with the procedures for
conducting hearings on appeals of administrative decisions in the
Administrative Procedures Ordinance of the City (Ordinance No.
3961). The determination appealed from shall be regarded as
prima facie correct. The examiner may affirm or reverse the
action of the health officer to deny or revoke a license. The
decision of the examiner shall be final unless a petition for
reconsideration by the examiner is accepted or appeal of the
examiner's decision is taken to the City Council pursuant to the
provisions of the Administrative Procedures Ordinance.
