franchise from Nation Wide Cablevision, Inc.,
to TCI Cablevision of Washington, Inc, and
amending Ordinance No. 3975 to reflect that
as s i gnment.
WHEREAS, TCI Cablevision of Washington, Inc., is acquiring
all the assets of Nation Wide Cablevision, Inc., relating to the
cable television system located in 'the City of Bremerton; and
WHEREAS, upon closing of the acquisition, all right, title,
and interest of Nation Wide Cablevision, Inc., in the franchise
as granted by Ordinance No. 3975 dated July 17, 1985, shall be
assigned to TCI Cablevision of Washington, Inc.; and
WHEREAS, TCI Cablevision of Washington, Inc., is
respectfully requesting that the City of Bremerton consent to
such an assignment of the franchise to TCI Cablevision of
Washington, Inc.;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BREMERTON
DOES HEREBY ORDAIN:
Section 1: Consent to Assignment. The City of Bremerton
hereby consents to the assignment of the franchise from Nation
Wide Cablevision, Inc., to TCI Cablevision of Washington, Inc.,
and the release of Nation Wide Cablevision, Inc., from any
further obligations or liability thereunder; provided, however,
that such consent shall not be effective unless TCI Cablevision
of Washington, Inc., delivers to the City of Bremerton a written
acceptance of all the terms and conditions of Ordinance No. 3975
prior to the effective date of this ordinance.
Section 2: Ordinance No. 3975. Ordinance No. 3975, ~1, is
hereby amended as follows:
Section 1: Purpose. This franchise shall constitute
an agreement between the City of Bremerton and TCI Cablevision of
Washington, Inc. , ~a~-i~4~-W~ ~a~l~v4~si~a~-~c_,, (hereinafter the
"Operator"). The Operator promises to construct, maintain, and
operate a cable television system for the distribution of
television and other electronic signals pursuant to the terms of
this franchise. The City agrees to grant the Operator all
necessary rights and privileges to use public rights of way
necessary for a cable television system. This agreement shall,
as of August 19, 1985, if previously accepted by the Operator,
supersede and replace all existing franchises previously granted
by the City of Bremerton to the Operator or any of its
predecessors, subsidiaries or affiliated companies.
