PASSED BY the City Council of the City of Bremerton, signed by the Mayor and attested to by the City Clerk in authentication of such passage on the ~7~d/~, day of (~~/~_//~ , 1986. ATTEST: ~,F. ENL. MCC~US~, City Clerk Director of Adminitrative Services ~-~'~ AN ORDINANCE amending Ordinance No. 4063, ~ ~ ~~-~--%~'(~ S3, which amended Ordinance No. 3700, earlier amended by Ordinance No. 3825, regarding an additional septage discharge fee to cover the costs of a septage monitoring program. THE CITY OF BREMERTON DOES HEREBY ORDAIN: SECTION 1: Ordinance No. 4063, §3, paragraph 6, is amended to read as follows: SECTION 3: ESTABLISHMENT OF USER CHARGE SYSTEM: A. General User Charge Criteria. 1. Types of User Charqe~. The user charge system shall consist of charges for (a) O & ' costs, (b) capital improvements, and (c) a facilities equity charge to new or expanding usage users. 2. Bi-Monthly User Charge Format. The basic bi-monthly wastewater user charge, for all users but the U.S. Navy, will consist of two (2) parts: a. A Fixed Charge which will include the cost of account billing procedures, a portion of capital cost contribution, and in the case of the residential user classes, the cost of a minimum amount of wastewater discharge. b. A Variable Charge which will depend on the volume of water consumed on (or wastewater discharged from) the user's premises and the typical strength for each user class. 3. Bi-Monthly Charges for U.S. Navy. The U.S. Navy will be charged bi-monthly for volume and strength of wastewater discharges only. That portion of capital costs attributable to system capacities for handling wastewater from the U.S. Navy will be recovered by provisions of a negotiated contract. 4. User Classes. 1 a. Strenqth of Wastewater. Ail users will be assigned to one of the following classes for purposes of fixing the typical strength of their wastewater discharges: 1. Residential - single family 2. Residential - multi-family 3. Commercial 4. High-strength commercial 5. Industrial 6. Septage' 7. Contract 8. Verified Strength. b. User's Discharqe Location. Users will be classified to indicate whether their premises are located within City limits, within Kitsap County Sewer Distric No. 1, or outside of both such areas. 5. TyDical a.n..d Ve.rified Stre. ngth. Once each year, the Wastewater Superintendent shall assign a typical waste strength to each user class except "verified strength," for purposes of determining user charges. Users in the verified strength class will have their strength determined by direct period composite samDling and analysis. Composite samples shall be collected and analyzed at the user's expense. To be eligible to be charged as a verified strength user, the user must have its discharge(s) to the wastewater system structured in such a way that sampling of the discharge(s) can be reasonabaly achieved without contamination or dilution by other discharges. If special provisions are required to achieve discharge sampling, such provisions shall be made at the user's expense. 6. A. Septage Charge. Septage haulers, licensed as a business with the City of Bremerton, may discharge waste at the wastewater treatment facility septage receiving station. Charge for the service is based upon a 1,500 gallon unit or portion thereof. a. Domestic septage charge will be $52.50 per unit. b. Non-domestic approved waste will be $75.00 per unit. Septage haulers whose septage charge is unpaid and delinquent shall not be allowed to discharge septage until ali delinquent charges are paid. c. To cover the costs of a septage monitoring program{ an .additional fee of one cent per gallon will be charged at each septage discharge and transferred for the Public Health Pooling Fund once each quarte'r. B. Operation and Maintenance Costs. The following methodology assures that the portion of the user's charge attributable to O & M Costs shall be determined in accordance with the quality and quantity of the user's waste discharge. 1. System Elements and Sub-Elements. 0 & M Costs shall be estimated annually for the following system elements and s ub-el ement s: a. Gravity sewers and minor pump stations. b. Transmission facilities. c. Treatment facilities. d. User account management (i) standard billing accounts; (ii) special and contract accounts. e. General administration and overhead. The costs for element "e" will be allocated to, and included in, elements "a," "b," and "c," in proportion to the direct costs for each such element. 2. Element-Parameter Cost. Annual O & M Costs for elements "a," "b," and "c" shall be allocated to flow, BOD, and TSS. Cost allocations for each parameter within each element will be identified as "element-parameter costs." 3. ~ser Class..Responsibilit¥ for Element Costs. An appropriate determination shall be made of which user classes shall be responsible for the cost burdens imposed by each respective element. 4. Element-Parameter-Class Loadings. The Wastewater Superintendent shall annually estimate the sewage flow, BOD and TSS expected to be discharged to each element of the wastewater system by each respective user class. These estimated annual quantities shall be expressed in terms of gallons (flow) or pounds (BOD, TSS). These quantities shall be termed "element-parameter-class loadings." The total loading of each parameter for all user classes combined for each system element shall be termed the "element-parameter loading." 5. Element-Parameter Unit Cost. Following tasks 1, 2, 3 and 4 above, the "element-parameter cost" for each element will be divided by the respective "element-parameter loading" to establish a value termed "element-parameter unit cost" which shall represent the 0 & M Cost of one unit (gallon or pound) of that parameter being handled through that system element. 6. volumetric Unit Charqe. The typical strengths of BOD and TSS for each user class will be expressed in pounds per cubic feet. When multiplied by the respective "element-parameter unit costs" for these parameters for each element, it will generate "parameter-element volumetric charges" in the form of cost per cubic foot. The parameter-element volumetric charge for the flow parameter will also be expressed in cost per cubic foot. The sum of 'all "Parameter-element volumetric charges" for all elements and for the parameters of flow, BOD and TSS as appropriate to each user class will then result in a "volumetric unit charge" for each respective user class, expressed in the form of cost per cubic foot of sanitary sewage. 7. Bi-Monthly Volumetric User Charqe. a. The bi-monthly volumetric user charge for each user or account will be computed by multiplying the appropriate "volumetric unit charge" by the' "adjusted volume" discharged by each user during the bi-monthly billing period. The "adjusted volume" of wastewater discharged is deemed to be eighty percent (80%) of the volume of water delivered to each user's premises as measured by a water service meter, or one hundred per cent (100%) of the volume of wastewater discharged to the system for accounts having wastewater flow meter provisions. In the event that water service meter readings for a user are not available to the City, it shall be assumed that such water consumption is equal to one and one-quarter (125%) times the water consumption by similar users or accounts for which water meter readings are available to the City. b. For purposes of computing the bi-monthly volumetric charge for all residential users, 400 cubic feet per bi-month per residential unit shall be deducted from the "adjusted volume" because the charge for such 400 cubic feet per bi-month per unit will be included in a flat charge portion'of the bill to each such user. In the event that a residential user's "adjusted volume" is less than 400 cubic feet per bi-month per unit, no volumetric unit charge shall be applied, but no deduction from the flat charge portion shall be allowed. c. A special basis for volumetric user charges will be applied to single-family residential classes of users during a s/x-m6nth period (either April-May, June-July, and August-September or May-June, July-August, and September-October billing periods, depending upon which bi-monthly cycle applies to a specific account). For such six-month period of probable irrigation use of metered water, volumetric charges for sewer service will not exceed the maximum volumetric charge for a bi-monthly billing during the preceeding six (6) months providing the user account was in effect and active for at least two billing periods of the preceeding six (6) months. The above allowance for irrigation usage of water may be extended to other than single family residential user class accounts providing the user applies for such allowance in writing and can reasonably demonstrate that such irrigation usage allowance is appropriate. 8. Flat Rate 0 & .M Charges. All users will be assessed a flat rate 0 & M charge on all service billings to include the equally allocated costs for standard billing and receiving (see Section 3(B)(1)(g)(i)). Additionally, special O & M charges for metering, sampling, analysis and/or special computer operations will be added to all bills for all users in the "contract", "septage" and "verified strength" user classes. (See Section 3(B)(1)(g)(ii)). The flat rate portion of 0 & M charges to all residential users will also include a charge for a minimum 400 cubic feet of wastewater discharge per residential unit per bi-monthly period. C. Capital Costs. The estimated funds for capital improvements, less amounts recovered through a contract with U.S. Navy and from specific grants, will be recovered by charges allocated to all users, except U.S. Navy. Any debt service or redemption costs for bonds or loans for wastewater system improvements will be treated as would direct payments for capital improvements. Part of the capital funds needed each year will be recovered by fixed bi-monthly charges apportioned to all non-Navy users on the basis of parameter design loadings and the remaining portion will be recovered by variable charges to all non-Navy users on the basis of volume and strength of actual discharges by users. Both fixed and variable charges will be allocated as though all improvements to all system elements would become functional at the same time and without regard to the actual schedule or sequence of construction. The following sequence of tasks defines the method of allocating capital cost obligations to system users: 1. Capital cost allocations to elements and parameters. The estimated capital costs for improvements will be allocated to at least the following elements of system improvements: a. Local gravity sewers and minor pump stations. b. Major pump stations and transmission lines. c. Headworks. d. Primary treatment. e. Seconda'ry treatment. f. Sludge digestion, sludge disposal. g. Disinfection. h. Laboratory facilities. i. Administration and service facilities. j. System controls. k. Land acquisition, landscaping and security. 1. Miscellaneous improvement related costs. Each of these allocated costs will be reduced by the amount of Navy capital cost participation appropriate to each element and by the amount of grant funds provided for each such element. The remaining costs for each element will be further allocated to the parameters of flow, BOD, TSS. These element-parameter net allocations will then be allocated equally to nih (9) cost recovery 'years and be termed "element-parameter annual capital cost" values. 2. Design capacity allocations to user classes. The parameter handling capacity designed for or allocated to each element listed in task 1 above will be allocated to user classes. Flow, BOD and TSS design capacities will be daily average values (gallons/day for flow and pounds/day for BOD and TSS). The parameter capacities of elements will be termed "element-parameter design loadings". When allocated to user classes, the allocations will be termed "element-parameter-class design loadings." 3. Capital costs per unit of parameter capacity. Each "element-parameter annual capital cost" from task 1 will be divided by the corresponding "element-parameter design loading" value from task 2 to generate values termed "element-parameter annual unit capital costs" (S/year per gallon/day, S/year per pound/day). 4. Capital costs per unit of flow capacity. The BOD and TSS design strength assumed for each user class (pounds/gallon) will be multiplied by the corresponding "element-parameter annual unit capital cost" values (S/year per pound/day) to yield "element-parameter annual volumetric unit capital cost" values (S/year per gallon/day). These values can then be added to the "element-parameter annual unit capital cost" for flow (also in S/year per gallon/day) to obtain combined "element annual volumetric unit capital cost" value for all three (3) of these parameters for each element and each user class. These unit volume values will then be added across all elements appropriate to each user class to ~btain "system annual volumetric unit capital cost values" (S/year per gallon/day) for each user class. 5. Fixed portion of bi-monthly capital charqes. This capital charge portion of bi-monthly billings to all users is intended to cover one-half (1/2) of the capital costs of all system improvements. Since the designed facilities provide capacities beyond the flow, BOD and TSS needs of currently connected users and als(wprovi~e capacity for storm flows that are not considered as a basis for charges, the capital charges for flow, BOD and TSS discharges by each user must be increased to fifty percent (50%) more than was assumed for purposes of actual design. For each user class, the "system annual volumetric unit capital cost" value from task 4 will be multiiplied by 1.5 (excess over design), then divided by six (six billing periods per year), and then again divided by 2 (one-half to be derived by fixed charge portion) to yield a "system bi-monthly fixed volumetric unit capital charge" value. (Note: 1.5 divided by (6 x 2) = 0.125 net multiplier to convert "annual volumetric" to "bi-monthly volumetric" values). This "system bi-monthly volumetric unit capital charge" (S/bi-month per gallon/day) will then be multiplied by the design volumetric capacity for each user in the class to determine the fixed capital amount to be charged on each bi-monthly bill for flow, BOD and TSS. 6. Variable portion of bi-monthly capital charges. The "system bi-monthly fixed volumetric unit capital charge" values from task 5 (S/bi-month per gallon/day) will be multiplied by 7.5 gallon/cubic foot, then divided by 60 days/bi-month, and then divided by 2 (Note: 7.5 divided by (60 x 2) = 0.0625 as a single step conversion) to derive a factor for the variable portion of bi-monthly capital charges for flow, BOD and TSS for each user class. These values will be termed "system bi-monthly variable volumetric unit capital charges" (S/cubic foot). The "adjusted volume" of wastewater discharge (see Section 3(B)(7)) for each user wil~ be multiplied by the "system bi-monthly variable volumetric unit capital charge" value for his user class. The resulting product will be the variable charge amount of capital costs to be included on the bi-monthly sewerage service bill. D. Facilities Equity Charqes. All new users who desire sewerage service by the wastewater facilities system of the City, and all existing users who desire to increase their potential usage of such system, shall be required, to pay a capital charge to establish an equity in the capital assets of the system. The facilities equity rights for currently connected users, and any equities that may subsequently be established, shall be presumed to be vested with, and inseparable from, the connected premises. The equities shall be transferred along with the premises being served whenever the legal ownership of such premises are transferred or conveyed by any method. The equity charge described here shall be in addition to any charges for sewer permits, for inspection fees, for construction of side sewers, or any other charges or costs associated with the extension of sewerage service from existing sewerlines to a user's premises. 1. Amount of Facilities Equity Charge. The amount to be paid to the City by users for any desired new or increased equity in capital assets shall be determined by the following formula: Facilities Equity Charge = Desired User .Capacity Existing System Capacity x Existing System Capital Value where the "existing system capital value" shall be the current undeprecited asset value of facilities less any current bond or loan indebtedness for capital improvements. 2. Payment and Distribution of Facilities Equity Charges. This equity charge shall be paid to the City prior to any use, or increase in use, of any sewerage service connection. In the case of users within Kitsap County Sewer District No. 1, a proportionate fraction of the equity charge payment shall be transferred to such district if the current capital value of that district's collection lines is determined and included in the equity charge formula. All other money received by the City as facility equity payments shall be applied to debt service or redemption of any outstanding bonds or loans for system capital improvements if any then be outstanding. If there should be no bond or loan indebtedness at the time of such facility equity fund receipts, then the facility equity receipts shall be placed in a cumulative reserve fund for renovation, major repair or replacement of wastewater facilities. 3. Facilities Equity Surcharge - Outside Users. There shall be a surcharge of fifty per cent (50%) applied to, and collected with, all facilities equity charges for those users or premises located outside the corporate limits of the City. 10 E. Connection Charge. Connection charges will be determined by the City Engineer on the basis of the following: a. Class A connections. (i) Single famiy dwellings - Two hundred Seventy Five Dollars ($275.00) per lateral service connection including inspection and permit fee; (ii) Multiple family dwellings - Twenty Five Dollars ($25.00) per residential unit but not less than Two Hundred Seventy-Five Dollars ($275.00) per lateral service connection including inspection and permit fees; (iii) Commercial buildings - $0.25 per square foot of floor space but not less than Two Hundred Seventy Five Dollars ($275.00) per lateral service connection including inspection and permit fees; (iv) Unoccupied property - no charges. b.
