HomeMy WebLinkAbout3700-A AN CRDINANCE establishing the policies for determining equit- able charges to be imposed on all users which discharge ~stew~ter to the ~ste~ter facility system operated by the City of Bre~erton. Section 1 states that the purpose of the ordinance is to distribute the capital and operation and maintenance cost in proportion to each user's demand for capacity and contribution to total system loading. Sectic~ 2 amends the definitional section of the current wsstewater rate ordinances. Section 3 sets forth three types of charges to be imposed on a user of the waste~ater system: 1. Charges for operation and maintenance; 2. Charges for capital improv~rents; and 3. A charge for new system users, or users who wish to increase their discharge loading to the system, ~hich is called a facilities equity charge. Users of the wmstew~ter system will be billed bi-n~nthly; each bill to con- tain a fixed charge, as ~11 as a variable charge. Users will be classified according to the typical strength of their waste discharge, and whether the user premises are located within the city limits, within Kitsap County Sewer District ~No. 1, or outside of both such areas. Dischargers of septic shall be charged for use of w~stewater system on the basis of the typical septage strength, the number of tank loads discharged and the volum~ of the holding tank from which the wastes are discharged, without regard to the actual quantity of strength of ~ste within each tank load. S~tion 3(B)(1-7) then sets forth the methodology to assure that each por- tion of the users charge attributable to operation and mintenance cost is deter- mined in accordance with the quality and quantity of the users waste discharge. This portion of bi-monthly bill will be determined by maltiplying the volumetric unit charge (~hich is determined by the six step methodology set forth in ordin- ance) by the adjusted volume discharged by each user during the bi-monthly bill- in~ period. The adjusted volum~ of ~ste~ter is d~c.~$~d to be 80% of the volu~e of ~tex delivered to each user's premises as n~asured by a ~ter service meter, or 100% of the volume of ~s~ter discharged to the system for a~ounts having m~ste~ater flc~ meter provisions. In the event that ~ter service meter read- ings for a user are not available to the City, it will be assumed that such ~ter co~sanlotion is equal to 125% of the ~ter coasunl~ic~ by similar users for accounts for which ~ter meter r ~a~ings are available to the City. For purposes of cce~0uting the bi-monthly volumetric unit charge for all single family resi- dential users, 400 cubic feet bi-monthly shall be deducted from the adjusted volume because the charge for such 400 cubic feet per bi-n~th will be i~clud~d in a flat charge portion of the bill to ~ac~-h such user. T~e ordinance a].~o establishes a special basis for volumetric user charges applied to a single family residential class of users during the six month sum~_r period. In additio~ to the variable charge described ~, all users will be assessed a flat rate O & M charge to inclucle the equally allocated cost for billing and receiving. The flat rate portion of the bi-~onthly bill will also include a charge for a minimum 400 cubic feet of ~aste~ater discharge per bi-~Dnthly period. The estimated necessary funds for capital improvement less capital costs to be recovered through a contract for sewer service provided to the U.S. Navy, unless funds are to be provided by specific grants, will be recovered by allocated charges to all users except the U.S. Navy. In order to maintain reasonable uniform charge rates throughout the period of construction and capital cost recovery, both fixed and variable charges will be allocated as though all improvements to all system elements ~Duld become fur~tional at the same time. Allocations to user classes in any construction or cost recovery year will be made without regard to the actual order or sequence of element construction. The methodology employed in allocating, capital recovery obligations to users is set forth in Section 3(C). All potential new users who desire to be connected for sewer services and all existing users who desire to increase their potential use of such system, shall be required to pay an appropriate capital charge to establish a fair pro- portionate equity in the capital assets of the system. This charge is called the facilities equity charge. This charge shall be paid to the City prior to any use or increase in use of the se~ar service connection. There shall be a surcharge of 50% applied to and connected with all facility equity charges for those users of premises located outside the corporate limits of the City. Connection charges will also be imposed on all new users of the ~ste~ater system. Section 4 provides that the charges for sewage services and for establish- ing a user's equity in facilities shall be determined and implemented as the basis for service billings and equity payments on and after September 1, 1982. The actual rates, as determined herein, shall be subject to review and approval by the elected officials of the City. Section 5 provides that the discharge of hazardous, toxic and interferring substances into the wastewater system is prohibited ar~ no person shall make connection of surface runoff or ground ~ter to a building sewer or building drain, which in turn is connected directly or indirectly to a public sanitary sewer. Section 6 provides that any person, firm or oorporation violating any pro- vision of this ordinance is guilty of a misdemeanor, and all charges provided for by this ordinance and Ordinance No. 3147, Section 4(B) ~hen the same beccmes delinquent and unpaid shall constitute a lien on the property. In addition, any such charge not paid before it becomes delinquent shall give the City the right and the ~ter 'superinte~t the duty, to shut off the water sevice to the pre- Sections 7, 8 and 9 of the ordinance set forth which sections of the exist- ing wastewater ordinance are repealed or amended. 3
