AN ORDINANCE granting a right-of-way vacation
on a portion of Rocky Point Road near the
northeast corner of Marine Drive/Rocky Point
Road Intersection in the City of Bremerton,
Washington.
THE CITY OF BREMERTON DOES ORDAIN:
SECTION 1: That a right-of-way vacation be granted to
the following-described property:
That portion of the SE 1/4 of the NW 1/4 of
Section 15, Township 24 N., R 1 East.,
described as follows: Commencing at the NW
corner of said SE 1/4 of the NW 1/4; thence S
88°49'15'' E 224.66 ft.; thence S t°23'34'' W
250.00 feet, to the true point of beginning;
thence continue S l°23'34'' W 88.00 feet;
thence N 88°49'15" W 22.80 feet to a point on
the easterly margin of the County Road,
thence along the east margin of the County
Road on the following courses: N 41o20'00'' W
2.63 feet; thence S 48040'00'' W 5.00 feet;
thence N 41°20'00'' W 68.85 feet; thence S
48o40'00'' W 5.00 feet to the beginning of a
curve to the right whose radius point bears N
48°40'00" E 447.50 feet; thence northerly
along the arc of said curve 24.74 feet;
thence leaving said curve N 67°13'12'' E 17.79
feet; thence S 72o26'44'' E 14.22 feet; thence
N 41o31'45'' E 8.43 feet; thence S 50°6'51'' E
34.68 feet; thence N 43o46'58'' E 48.13 feet
to the true point of beginning.
Said right-of-way vacation described as
follows:
Beginning at the NW corner of the SE 1/4 of
the NW 1/4 of Section 15, T 24 N, R ! E,

88°49'15'' W 22.80 feet to a point on the
easterly margin of the county road; thence N

true point of beginning of this right of way
vacation; thence continuing N 41020'00', W
53.85 feet; thence South 48°40'00" W 15 feet;

48040'00'' E 15 feet to the true point of
beginning.
and the same is hereby granted subject to the following:
1. At such time the City deems necessary, the concrete
retaining wall obstruction within the subject
right-of-way shall be removed at the owner's expense.
2. Prior to the final passage of the vacation ordinance
the applicant shall pay the City one-half the appraised
value of the subject area of right-of-way to be vacated
in accordance with RCW 35.79.
3. This right-of-way vacation is subject to the various
requirements contained in the Bremerton Area Plan,
Bremerton Zoning Ordinance, Uniform Building Code, and

4. In the event the City of Bremerton decides to widen
Rocky Point/Marine Drive, owner will pay the costs of a
retaining wall built adjacent to the vacated
right-of-way.

northwest corner of the house running parallel to the
right-of-way centerline the entire length of the house
