AN ORDINANCE vacating rights-of-ways within Bremerton
Gardens PUD.
W~EREAS, the Bremerton City Council approved vacation of
certain right-of-way within the Bremerton Gardens Apartment Planned
Unit Development following public hearing on May 10, 1989; now,
therefore
T~ ~ITY OF BREMERTO~ DOES ORDAIN:
SECTIO~ ~. Vacation. The following rights-of-way are hereby
vacated:
See Exhibit "A" attached hereto and incorporated
herein by this reference.
SECTIO~ Z. Conditions. This right-of-way vacation shall be
subject to the following condition:
As compensation to the City for the vacated rights-of-way, the
applicant shall deed to the City approximately 3.3 acres,
consisting of all tidelands of the applicant's property from the
point of mean !~igh tide to the westerly property boundary, said
conveyance to incorporate and satisfy the applicant's shoreline
permit condition for dedication of a 12-foot wide pedestrian
easement. Said deed, approved by the City Attorney, shall be filed
concurrently with this vacation.
SECTIO~ 3. Effective Date. This ordinance shall become
effective ten (10) days from passage and publication.
