AN ORDINANCE vacating portions of Kitsap Way abutting lots 25
through 28, Block A, "Oyster Bay Addition", subject to reservation
of utility easements and other conditions.
WHEREAS, The owner of property abutting Kitsap Way has initiated
proceedings for vacation of a portion of said right-of-way
consisting of approximately 3,098.00 sql/are feet adjacent to lots
25 through 28, Block A, "Oyster Bay Addition"; and
WHEREAS, notice has been posted and published according to law and
a public hearing held on July 12, 1988; and
WHEREAS, the council finds that said portion of right-of-way set
forth herein are not needed for present or future traffic
circulation and should be vacated to the adjoining property owner,
BRC Partnership; now, therefore
THE CITY OF BREMERTON DOES ORDAIN:
SECTION 1. Vacation. -The following rights-of-way are
hereby vacated to the adjoining p~operty owner:
See Exhibit A attached hereto and incorporated by
reference herein.
SECTION 2. Conditions. This right-of-way vacation shall
be subject to the following conditions and restrictions:
1. The applicant shall pay compensation as established by
the City Attorneys office prior to second reading hereof.
2. Necessary easements for~'existing and future utilities are
hereby reserved.
3. Landscaped areas of the vacated right-of-way shall be
maintained as required by the Bremerton Zoning Code, Title 21 BMC.
SECTION 3. Effective Date. This vacation shall become
effective ten (10) days from passage and publication.
