AN ORDINANCE vacating a portion of Charlotte Avenue abutting
Lots 33 thru 40, Oyster Bay Addition.
u~ WHEREAS, Ronald and Kathy Karlberg, owners of property
~ abutting right-of-way platted in Block A, Oyster Bay Addition, have
~ petitioned the City Council to formalize vacation of said right-
~ of-way by operation of law; and
oo WHEREAS, the Council finds that platting and development of
this right-of-way meets the requirements of vacation by operation
of law; now,,therefore
SECTION 1. The following right-of-way is hereby vacated
without condition or reservation of rights:
Lots 33 thru 40, Block A, Oyster Bay Addition, as recorded
in Vol. 2, pg. 63, of Plats of Kitsap County, WA, except
Kitsap Way.
APPROVED by the City Council on the first reading this
PASSED by the City Council of the C' of Bremerton this

RONALD AND KATHY KARLBERG being first duly sworn on oath, depose
and say: That they are the owners of the following described real
property located in the City of Bremerton, Kitsap County,
Washington:
Lots 33 thru 40, Block A, Oyster Bay Addition, as recorded in Vol.
2, pg. 63, of Plats of Kitsap County Washington, except Kitsap Way.
That the Street known as Charlotte Ave. abutting the above
described property from the north margin of Kitsap Way to the south
margin of llth Street was platted on July 8, 1902; that your
affiant has researched the matter and established that, although
platted, said Street was not used for Public purposes or improved
in any manner for a period of five years from 1902 thru 1907, and
in fact has not to this date been so improved. That pursuant to
the laws of the State of Washington, 1889-90, Chapter 19, Section
32, Page 603, said property was automatically vacated by operation
of law.
