(Howard Burrows) WHEREAS, the City Council of the City of Bremerton has heard testimony on the rezone of the property at 1151 East Broad Street, Bremerton, Washington, and has reviewed the record and resolution of the Bremerton Planning Commission; and WHEREAS, the City Council has adopted the findings and conclusions of the Planning Commission to wit as contained in Resolution No. 707; Findinqs of Fact 1. Use: The uses which would be permitted in a B-3 zone are listed in Exhibit "C" of Planning Commission Resolution No. 707. 2. Structure, density and lot provisions for nonresidential building: Maximum allowable height: 30 feet Maximum lot area coverage: 100% (see yard requirements below) Front Setback: 40 feet from street centerline Side yard setback: 5 feet on East side and 5 feet on West side Rear yard setback: 25 feet 3. Provision of bicycle parking according to the adopted Bicycle Parking Standards is encouraged. 5. Impervious Surface: Impervious Surface coverage of the subject site could reach 100% under current Zoning Ordinance provisions. 6. Openspace (space not covered by buildings): No minimum amount of openspace is required in a B-3 zone, however, the setback requirements listed above would apply and would result in some openspace remaining on the lot. 7. Hours of Operation: Not restricted by Zoning Ordinance provisions. 8. Traffic Generation: An increase in traffic generation should be expected from a site rezoned from R-1 to B-3. Broad Street can accommodate any additional traffic which could be generated from any B-3 use established at the subject site. 9. Basis for Request (Applicant's Statement): To use subject property for a barber shop. 10. Existing Use: Vacant structure, 20 X 35 feet, formerly used as a home on lot 50 X 70 feet. 8410120046 l [[t322Fl 1536 11. Existing Zoning: See Exhibit "B" of Planning Commission Resolution No. 707. 12. Surrounding uses and Zoning: See Exhibit "F" of Planning Commission Resolution No. 707. North: Mixed commercial uses (B-3) East: Mixed Commercial uses (B-3) South: 10 acre residential lot (R-l) West: Low density residential (R-l) 13. Right of way width: 60 feet b. On street parking: not restricted c. Traffic count.: none available d. Pavement width: approximately 40 feet e. Alley: none 18. Nearest Bus Route: The following buses run on Wheaton Way, within several hundred feet of the subject site. #13 Silverdale via Eastside %21 Perry Avenue %29 Trenton Avenue %50 Sunday East Loop 19. Nearest Bicycle Route: Sylvan Way (within 3 long blocks. ) 20. Neighborhood: Sheridan (District 1): Applicable Neighborhood Planning Statement Policies: See Exhibit "E" of Planning Commission Resolution No. 707. 21. Planning Commission Preliminary Zoning Map "M-6C" dated 2-19-82 designates the subject site "PLA-B", a planned area requiring special evaluation. 22. State Environmental Policy Act (SEPA): Proposal is exempt from SEPA requirements. (Any one story business development would be under 4,000 square feet. A larger structure would be evaluated under SEPA when a building permit is received.) 23. Bremerton Area Plan: See Exhibit "D" of Planning Commi.~-~ion Resolution No. 707. 24. Zoning Ordinance: Development or redevelopment of the site must meet all applicable requirements of the Zoning Ordinance. ConclusiQns 1. The proposed rezone would be generally consistent with Bremerton Area Plan Policies and the Sheridan Neighborhood Planning Statement policies. 2. If approved, the proposed rezone would permit the establishment of uses which would be generally ~4~0~Z004~compatible with the uses surrounding the site to the North and East. Because of the orientation of the subject site onto Broad Street and because of the close proximity of Wheaton Way, a major arterial, the proposed rezone will probably have minimal impact on residential uses to the South. No potential .impacts have been identified to uses to the West'from the proposed rezone. 3. If approved, the proposed rezone could provide an incentive for the redevelopment and rehabilitation of structures on Broad Street, including the structure on the subject site which has been identified as substandard and in need of r ehabil itation. Such r edevel opment and rehabilitation would be in the best interest of the community. 4. The subject site has adequate access and all utilities (except sanitary sewer) for the uses which should be established at the site under a B-3 zone. The septic system currently serving the site is adequate for certain uses permitted in the B-3 zone. 5. Significant changes in the character of portions of the surrounding area have occurred during the past several years, including the establishment of a number of commercial developments, which would be compatible with uses permitted in a B-3 zone. 6. Any redevelopment or rehabilitation of the site must be consistent with the Zoning Ordinance requirements and other development laws and standards currently in effect at the time of construction. 7. Based on the above conclusions and from the information presented by the various City departments as contained in Planning Commission Resolution No. 707, no significant reasons have been identified to deny the proposed rezone. No information was identified at the Planning Commission public hearing to deny the request to a business zone. NOW THEREFORE, THE CITY OF BREMERTON DOES HEREBY ORDAIN: ~: That the use and area maps of Ordinance No. 1792, are hereby amended in conformity with Title IV, Chapter 1 thereof, as follows: Subject property: Olaf Linne's Home Tract, Lot ~13, Volume 8 of Plats, Page 18, Kitsap County, Washington.
