McCLUSKEY, Clerk ATTACHMENT FINDINGS AND CONCLUSIONS OF RESOLUTION NO. 754 (Rainier National Bank) FINDI]!~$_Q~_J~A~ 1. Applicant's Stated Intention: Rezone is requested to that the proposed zone (B-3) is compatible with the present use of the site. The existing zone is R-2. Please see the following sections for all the uses permitted in the current and proposed zones. R-2 - Section 400, page 17 B-3 - Section 513, pages 31-34 2. History of Site: The site has been developed, with adjoining land, into a large motel complex (presently known as the Bayview Inn and Holiday Cinemas) which include several related accessory uses. These include a restaurant, a night club, meeting and banquet facilities, a dance hall and a movie theater. A recent change of ownership has divided these facilities from the Trident Building located immediately to the East of the Bayview Inn Complex. In conjunction with the change in ownership, a short plat application has been submitted to the City of Bremerton. Prior to approval of the short plat application, several problems have been or are being addressed, one of which is the setback requirement for parking along the Kitsap Way property line. A rezone to B-3 of the subject has been requested and will eliminate the problem. 3. Zoning Ordinance Provisions: R-2 ~Zo~ B-3 Zo~ Maximum Depends upon building Same as R-2 zone Residential configuration, but in Density theory could reach 70 units per acre Maximum Generally 70 feet 30 feet if adjacent Height or 6 stories to residential, otherwise, 85 feet above sidewalk elevation Front 15 feet 40 feet from street Setback centerline for non- residential use Rear 15 feet/20 Same as residential Setback feet if over when adjacent to 3 stories R zone; otherwise none Side 5 to 9 feet, 5 feet when adjacent Setback depending on to residential; height otherwise zero Minimum 4300 square feet Same as R-2 zone Lot Size for first 2 units, for Residential then depends upon building configuration Openspace Setbacks and land- Setbacks and land- scaping requirements scaping areas of of parking areas parking areas result in some result in some openspace openspace 4. Estimated Traffic Generation: An increase in traffic could be expected from property rezoned from R-2 to B-3, however, because the site is presently developed with a newer commercial structure and accessory uses, no change in traffic generation is expected from the site. 5. Parking: If rezoned, parking which at the present time occurs in the front yard setback will be in compliance with zoning ordinance setback provisions, as the R-2 setback is 15 feet from the front property line and the B-3 setback is 40 feet from the centerline of the street. 6. Existing Use and Structures: The subject site is currently used for parking for the Bayview Inn. 7. Surrounding Uses and Zoning within 250 feet: Please see Exhibit A of Planning Commission Resolution #754. 8. Total Lot Area: rectangular; 48,055 square feet. 9. Soils and Topography: The subject site is adjacent to a steep slope. 10. Existing Environment: Developed urban environment. 11. Access to Subject Site: Access to the subject site is gained from Kitsap Way. 12. Information Regarding Adjoining Right-of-Way: Area or Location Identification: Bayview Inn - Kitsap Way Right of Way Width: 80-90 feet Pavement Width: 44 feet Number of Lanes: 2 lanes each direction Type and Condition of Surface: Fair No on or off-street parking is provided. Traffic Count: 11520 (AWDT) taken in 1984 on the West side of SR-3 Sidewalks are provided in the East and West sides of the street. 13. Existing Utilities: The subject site is served by all common urban utilities. Sanitary Sewer: Yes Storm Sewer/drainage: No 14. Nearest Bicycle Route(s): Kitsap Way. 15. Nearest Bus Route(s): 20 - Navy Yard City 28 - Poindexter/Kitsap Lake 12 - Silverdale West 16. The subject site falls within Council District No. 9. The Kitsap Lake Neighborhood Plan map (unadopted) designates the subject site as Business. Please see Exhibit C of Planning Commission Resolution #754 for applicable Neighborhood Plan Policies. 17. State Environmental Policy Act (SEPA): Declaration of Non- Significance issued June 28, 1985. No areas of significant concern have been identified with respect to the proposed rezone. 18. Bremerton Area Plan: See Exhibit B of Planning Commission Resolution #754 for applicable policies. CQN~L~$IQNS The proposed rezone would be generally consistent with Bremerton Area Plan Policies which call for the location of commercial areas which are compatible with surrounding areas. The area has undergone substantial change over the past 10-15 years. The site is adjacent to other property which has been rezoned to B-3 and would make a logical extension of the B-3 zoned property. The proposed rezoning will bring into zoning conformity those parking spaces currently developed in the R-2 front yard setback. If the subject rezone is approved, a small undeveloped parcel of R-2 zoned property will remain to the North of the subject site. The parcel to the North is not included in the subject application, however, a rezone of the subject site could set a precedent for a rezone of the site adjacent to the North.
