Determine that the permit conditions may be changed and that the use may continue in accordance with the new conditions; or 3. Find that the conditions of the permit are not being met and require compliance with the conditions within a specified time period; or 4. Find that the conditions of the permit are not being met and order the use to cease and desist. 10 The joint use of parking facilities may be established by special use permit approved by the Planning Commission under the following conditions. A. Up to fifty percent (50%) of the required parking for a theater, auditorium, bowling alley, or dance hall may be supplied by the off-street parking provided by certain types of uses referred to as "daytime" uses in part (D) below. B. Up to fifty percent (50%) of the required parking for uses specified in part (D) below, "daytime" uses, may be supplied by the parking facilities provided by uses referred to as "nightime" uses in part (E) below. C. Up to seventy percent (70%) of the required parking for a church or for an auditorium incidental to a public or private school may be supplied by the off-street parking facilities provided by uses referred to as "daytime" uses in part (D) below. D. The following uses are considered as primary daytime uses: banks, offices, personal service shops, or wholesale buildings and similar uses. E. The following uses are considered as primary "night-time" or Sunday uses: auditoriums incidental to a public or private school, churches, bowling alleys, dance halls, or theaters. F. The following conditions shall be met as a requisite for joint use of parking requirements: (1) The building or use shall be located within an eight hundred (800) feet radius of the joint parking facilities, but not across an arterial road unless within one block of a signalized intersection. (2) The applicant shall show that there is no substantial conflict in the principal operating hours of the two (2) uses for which joint use of off-street parking facilities is proposed. 11 (3) A properly drawn legal instrument, approved by the City Attorney and executed by affected parties, shall be recorded with the County Auditor. The right to occupancy of the premises for which the off-street parking facilities are maintained shall terminate if facilities cease to be available to the premises for parking purposes. Off-street loading zones containing two hundred and fifty square feet of area with no dimension less than ten (10) feet shall be required as an accessory use. A. One (1) off-street loading space shall be provided for new construction or additions having a floor area of between one thousand (1,000) square feet and twenty thousand (20,000) square feet per building, with the exclusion of office buildings of less than ten thousand (10,000) square feet of floor area. B. One (1) additional off-street loading space shall be provided for each additional twenty thousand (20,000) square feet or fraction thereof of floor area in excess of twenty thousand (20,000) square feet. C. No approval shall be granted for building permits, certificates of compliance, occupancy permits, until a plot plan showing the loading space has been approved by the Building Inspector. D. A loading space may occupy all or part of any rear yard. No loading space shall be located closer than twenty (20) feet to any lot in a residential zoning district unless separated from the district by a solid fence or wall not more than six (6) feet or less than five (5) feet in height. E. All loading spaces shall be accessible, at all times, from a street, alley, or driveway intended to serve the off-street loading. If access to loading spaces involves the utilization of parking areas, no interference with the normal use and function of parking areas shall be permitted. Access to loading spaces shall not be blocked by other loading spaces nor by permanent or movable structures of any type, including trash receptacles or compactors. Loading spaces shall not interfere 12 with any fire exit or emergency access or occupies any part of a public right-of-way. F.
