THE CITY COUNCIL OF THE CITY OF BREMERTON DOES HEREBY ORDAIN: SECT~Q~_~: ~tk~__T~/_~. This Ordinance may be referred to as the Downtown Off-Street Parking and Loading Ordinance. ~Q~_~: Ordinance No. 1792, Title II, Chapter VII is amended by adding thereto three new sections, numbered 760, 761 and 762 respectively, to read as follows: $~Q~_~60: PARKING PROVISIONS IN A BUSINESS DISTRICT A. The Central Business District is identified as the area bounded 1. on the South: by Puget Sound Naval Shipyard 2. on the West: by the rear property line of all properties immediately adjacent to the West of Warren Avenue 3. on the North: by the rear property line of all properties immediately adjacent and to the North of Sixth Street 4. on the East: by Puget Sound's outer harbor line. B. Intent Circumstances make the Central Business District different from the remainder of Bremerton in the following ways: 1. That there exists a concentration of transit. 2. There exists a concentration of private commercial parking facilities. 3. There is the availability of public parking. 4. There are land resources substantially developed in a manner which makes it unreasonable to require off- street parking as a condition to the use of the individual lots. 5. The Central Business District is, and should continue to be, a concentrated area of retail, office, and other approved uses in a pedestrian scaled environment. 6. ~he Puget Sound Naval Sh~_lard, the County's largest employer, is adjacent to the Central Business District and both provides substantial on-site parking and produces large numbers of pedestrians at certain periods of the day. Because of these factors, but still recognizing the need to provide parking to serve the needs of Central Business District and provide for the public health, safety and welfare, a different set of off-street parking and loading regulations shall apply to the Central Business District. C. Provisions 1. Within the geographic bounds of the Central Business District as identified in this section, there shall be no required parking for structures or uses, nor shall parking be required for rehabilitated or remodeled structures, or when obtaining a certificate of occupancy. 2. No loading zones are required. Nothing in this section shall in any way affect the specific obligation of persons to comply with the requirements for providing off-street parking and loading area~which are set forth in the Bremerton Zoning Ordinanc~ in other areas of the City. The provisions in this section only apply to off-street parking and loading requirements in the central business district. ~3D~__162: The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance or the validity of its application to other persons or circumstances.
