AN ORDINANCE to vacate the northern 95 feet of
Magnuson Court that is one lot depth north of
Magnuson Way, one block west of the Magnuson ~T~.~,c COUN~YAU~ITO~
Way and Fir Avenue intersection, ~pproved per
petition of John Stanley (SV-3-88).
WHE~S, a petition requesting vacation of that certain
northern 95 feet of Magnuson Court that is one lot depth north of
Magnuson Way and one block west of the Magnuson Way and Fir
Avenue intersection in the City of Bremerton, more particularly
described below, has been fil~ with the City Council of
Br~erton; and
W~E~S, the Bremerton Planning Commission held a duly
noticed public hearing on August 21, 1984, at which
recommendation was made to the City Council for approval of this
vacation; and
W~E~S, the Bremerton City Council on October 17, 1984,
held a duly noticed public hearing for the purpose of receiving
public c~ment on this vacation voted to adopt said vacation
ordinance; now, therefore
~E CITY OF BRE~T~ DOES HE.BY O~AIN:
SECTION 1. That excepting all necessary utility
easements, the northern 95 feet of Magnuson Court that is north
of Magnuson Way and one block west of the Magnuson Way and Fir
Avenue intersection in the City of Bremerton, more particularly
described as:
Beginning at the SW corner of Parcel 9 as shown on the
amended plat of the Fourth ~dition to Sheridan Park as
recorded in Vol~e 9 of Plats, page 3, records of the
Auditor of Kitsap County, WA; thence S 87.30' E along
the S line of said Parcel 9 a distance of 84.15' to the
true point of beginning; thence N 2.30' E 95.00';
thence S 87.30' E 60.00'; thence S 2.30' W 95.00';
thence N 87.30' W 60.00' to the true point of beginning.
BE AND THE SAME HEREBY is declared vacated subject to the
conditions set forth below.
SEC~IO~ 2. This vaca%ion is subjec% to the following
conditions:
1. The City reserves a ten foot {10' ) wide easement
for present and ~uture utilities centered
along the existing sanitary sewer main in the area
of the street vacation.
2. Compensation for this vacation shall be paid to

the City Clerk in full in the amount of one-half
of the fair market value prior to the final
reading of this ordinance.
APPROVED by the City Council on the first reading this
