HomeMy WebLinkAbout4368 ORDINANCE NO. ~ ~' fi2q ORDINANCE relating to business regulatory license fees and amending Chapters 5.03, 5.04, 5.10, 5.12, 5.16, 5.17, 5.20, 5.22, 5.36, 5.38, 5.42, 5.46, 5.54, 5.76, 5.96, 5.98, 9.48 and 10.24 of the Bremerton Municipal Code, adopting a new Chapter 5.25 and repealing Chapters 5.68 and 5.92. THE CITY OF BREMERTON DOES HEREBY ORDAIN: Section 1. Amendment. Section 5.03.040 [GENERAL PROVISIONS FOR REGULATORY LICENSES] is amended to read as follows: 5.03.040 LICENSE ISSUANCE - FEES. (a) Application must be received by the City Clerk at least three (3) weeks prior to issuance. (b) License fees will be due upon application, o,,c~- ~ :-.~:..:~..~ ~t.n_~,~ ...................... ~, .... The City Council shall establish for appropriate fees by resolution. Unless otherwise specified in individual chapters: (1) Fees are non-refundable; (2) Fees are prorated for expiration on June 30th of each year. (3) Licenses must be renewed on July 1st of each year. (4) In the event a license renewal fee is not paid within fifteen (15) days of the due date there shall be levied a late charge of $10.00. (c) Within five (5) days of the filing of an application under this Section and the receipt of the correct license fee, the City Clerk will forward copies to the Police Department and every other appropriate department for their review. Each department will respond, within fourteen (14) days of receipt of such application, with a recommendation based on its investigation. Section 2. Amendment. Section 5.04.010 [PET SHOPS AND KENNELS] is amended to read as follows: 5.04.010 PET SHOP AND KENNEL LICENSE REQUIRED. (a) It is unlawful for any person to own, maintain, or operate a kennel or pet shop, as defined below, in the City of Bremerton unless said person has procured a pet shop or kennel lice A k (b) "Pet shop" means and shall be defined as any place, establishment, store, or department of any store, that handles live animals, including dogs, cats, rabbits, birds, reptiles, other fowl or fish, and offers to sell or rent to the public such animals at retail or wholesale. (c) "Kennel" means and shall be defined as a commercial establishment for the breeding or boarding of dogs or cats. Section 3. Repeal. Section 5.04.020 PET SHOP AND KENNEL LICENSE FEE [PET SHOPS AND KENNELS], is hereby repealed in its entirety. Section 4. Repeal. Section 5.10.030 LICENSE APPLICATION AND FEE [PAWNBROKERS AND SECONDHAND DEALERS], is hereby repealed in its entirety. Section 5. Repeal. Section 5.12.060 LICENSE FEE [CLOSING OUT, REMOVAL AND DISTRESS MERCHANDISE SALES], is hereby repealed in its entirety. Section 6. Amendment. Section 5.12.080 [CLOSING OUT, REMOVAL AND DISTRESS MERCHANDISE SALES] is amended to read as follows: 5.12.080 LICENSE - RENEWAL. At any time during the period of the license, application may be made to the City Clerk showing that all goods in the original inventory have not been sold, accompanied by an itemized inventory of the remaining unsold goods, and if it appears to the City Clerk that undue hardship will result unless the license is extended, the license may be extended and renewed on a daily basis upon the payment of an additional license fee ^~' ~":'-' ..1~11~.~ ...... j ...... per flay, which license shall ~,n:. remain in effect only so long as the daily license fee is paid and the licensee shall comply with the provisions of this chapter. Any application for such a license under the provision of this chapter covering any goods, wares or merchandise previously inventoried and licensed, shall be deemed to be an application for renewal under this section, whether presented by the original applicant or by any other person. Section 7. Amendment. Section 5.16.030 [TEMPORARY MERCHANTS, PEDDLERS AND MOBILE FOOD VENDORS] is amended to read as follows: 5.16.030 LICENSE - F-E~8--PrIq~ TERMS. (a) Temporary Merchants. A temporary merchant's license will be issued only twice in a calendar year. If a temporary site is used for itinerant sales, it must be situated on private property. The site and any temporary structure, excluding motor vehicles and trailers, must be approved by the building official and planning and fire departments before license issuance. (b) Peddlers. The license must be posted inside the vehicle. Section 8. Amendment. Repeal. Sections 5.22.020 LICENSE -FEE and 5.22.030 LICENSE - ONE MONTH [PUBLIC DANCES], are hereby repealed in their entirety. Section 12. New Chapter. A new Chapter 5.25, CHRISTMAS TREE LOTS, is hereby added to Title 5 to read as follows: 5.25.010 LICENSE REQUIRED. It is unlawful for any person, firm or corporation to open, maintain or operate a Christmas Tree Lot without first obtaining a regulatory license in addition to a business license. 5.25.020 DEFINITIONS. For the purpose of this chapter the following shall be defined: (a) "Christmas Tree" shall mean those trees of the varieties and kinds used for decorative purposes which have been cut and are no longer attached to the soil. (b) "Christmas Tree Lot" shall mean any place on private property where Christmas Trees are stored, displayed and sold. (c) "Public Street" shall mean all that property set aside for street purposes or street rights-of-way and shall include sidewalks, curbs, shoulder, parking strips and alleys. 5.25.030 REGULATIONS. No Christmas tree lot shall be located on any public street in the City of Bremerton. Any Christmas tree lot shall be maintained in such a manner as to eliminate insofar as possible any fire hazard. No trees which have become dried out shall be kept in the licensee's premises. Upon expiration of the Christmas Tree Lot's license the licensee must remove and dispose of all excess trees, cuttings and debris in a lawful manner within seven days. 5.25.040 LICENSE TERM. A Christmas Tree Lot License may be obtained anytime after November 1st of any given year. All licenses expire December 26th of the same year. Section 13. Amendment. Chapter 5.36.020[SPECIAL EVENTS] is amended to read as follows: 5 36 020 LICENSE -~ TERMS ~r~.~ ,: ..... ,'~ ~' ....... :~ ....... u~. u^ reserves the right to charge any sponsor of a special event direct costs incurred by the City as a result of the event. Such costs may include the cost of barricading streets, plan reviews, or public safety involvement. Section 14. Repeal. Section 5.38.020LICENSE- FEE [THEATERS], is hereby repealed in its entirety. Section 15. Repeal. Section 5.42.030 LICENSE -FEE [HOTELS/MOTELS], is hereby repealed in its entirety. Section 16. Repeal. Section 5.46.040 LICENSE FOR MUSIC, DANCING OR ENTERTAINMENT [LIQUOR ESTABLISHMENTS], is hereby repealed in its entirety. Section 17. Repeal. Section 5.54.080 LICENSE FEE [TAXICABS], is hereby repealed in its entirety. Section 18. Amendment. Chapter 5.54.120 [TAXICABS] is amended to read as follows: 5.54.120 APPLICATION FOR TAXICAB DRIVER'S PERMIT. The application shall be verified under oath and shall contain the following information: (a) A copy of the applicant's driving record; (b) A concise history of his or her employment; and (c) Pictures and fingerprints. In order to renew, the licens~ shill rmpply using application 7 procedures and requirements set forth in Chapter 5.03. Section 24. Amendment. Chapter 5.96.080 [EROTIC DANCE STUDIOS] is amended to read as follows: 5.96.080 DANCER'S LICENSE - F,E,E-,-- TERMS - RENEWAL. a .....,~ ,: ......1.~,, ~.~ ,~c, nt~ ........A dancer's license shall entitle a dancer to dance only at the business indicated on the license. In order to renew, the licensee shall reapply using application procedures and requirements set forth in Chapter 5.03. Section 25. Repeal. Section 5.98.050 LICENSE -FEE [SHUTrLE BUS AND LIMOUSINE SERVICES], is hereby repealed in its entirety. Section 26. Amendment. Chapter 9.48.010[FIREWORKS] is amended to read as follows: 9.48.010 PERMIT - REQUIRED - FEE. It is unlawful for any person, firm, or corporation to engage in the retail sale of, or to sell any fireworks within the City without first having o ned a perm r the year of such sale, Section 27. Amendment. Section 5.10.030 LICENSE - APPLICATION AND FEE (PAWNBROKERS AND SECONDHAND DEALERS), is hereby repealed in its entirety. Section 5. Repeal. Section 5.12.060 LICENSE - FEE (CLOSING OUT, REMOVAL AND DISTRESS MERCHANDISE SALES), is hereby repealed in its entirety. Section 6. Amendment. Section 5.12.080 (CLOSING OUT, REMOVAL AND DISTRESS MERCHANDISE SALES), is amended as follows: 5.12.080 LICENSE - RENEWAL. The license fee of $50 is removed from this section. Section 7. Amendment. Section 5.16.030 (TEMPORARY MERCHANTS, PEDDLERS AND MOBILE FOOD VENDORS) is amended as follows: 5.16.030 LICENSE. The license fees of $200 for Temporary Merchants, $50 for Mobile Food Vendors and $10 and $50 for Peddlers are removed from this section. Section 8. Amendment. Chapter 5.17.040 (CHARITABLE SOLICITATIONS) is amended as follows: 5.17.040 CHARITY SOLICITATION LICENSE. The license fee of $10 has been removed from this section. Section 9. Amendment. Chapter 5.17.050 (CHARITABLE SOLICITATIONS) is amended as follows: 5.17.050 PROFESSIONAL FUND RAISER LICENSE. The license fee of $500 has been removed from this section. Section 10. Amendment. Chapter 5.20.040 (STREET/SIDEWALK VENDORS) is amended as follows: 5.20.040 LICENSE. The license fees of $150 for Profit Enterprises and $25 for Charitable Organizations are removed from this section. Section 11. Repeal. Sections 5.22.020 LICENSE - FEE and 5.22.030 LICENSE - ONE MONTH (PUBLIC DANCES), are hereby repealed in their entirety. Section 12. New Chapter. A new Chapter 5.25, CHRISTMAS TREE LOTS, is hereby added to Title 5 as follows: 5.25.010 LICENSE REQUIRED. Christmas Tree Lots must be regulatory licensed. 5.25.020 DEFINITIONS. "Christmas Tree", "Christmas Tree Lots", and "Public Street" are defined. 5.25.030 REGULATIONS. Location and operating requirements are specified. 5.25.040 LICENSE TERM. Lots are permitted from November 1st to December 26th of any given year. Section 13. Amendment. Chapter 5.36.020 (SPECIAL EVENTS) is amended as follows: 5.36.020 LICENSE. Fees of $150/14 days and $25/each additional day is removed from this section. Non-profit organizations exemption from a license fee is removed. Section 14. Repeal. Section 5.38.020 LICENSE - FEE (THEATERS), is hereby repealed in its entirety. Section 15. Repeal. Section 5.42.030 LICENSE - FEE (HOTELS/ MOTELS), is hereby repealed in its entirety. Section 16. Repeal. Section 5.46.040 LICENSE FOR MUSIC, DANCING OR ENTERTAINMENT (LIQUOR ESTABLISHMENTS), is hereby repealed in its entirety. Section 17. Repeal. Section 5.54.080 LICENSE FEE (TAXICABS), is hereby repealed in its entirety. Section 18. Amendment. Chapter 5.54.120 (TAXICABS) is amended as follows: 5.54.120 APPLICATION FOR TAXICABS DRIVER'S PERMIT. The license fee of $25 is removed from this section. Section 19. Amendment. Chapter 5.54.160 (TAXICABS) is amended as follows: 5.54.160 ISSUANCE OF TAXICAB DRIVER'S PERMIT - DURATION. The license fee of $25 is removed from this section. Section 20. Repeal. Section 5.68 SECURITY OFFICERS, is hereby repealed in its entirety. Section 21. Repeal. Sections 5.76.020 LICENSE - FEE and 5.76.030 SPECIAL LICENSE FEE (ADVERTISING MATTER) are hereby repealed in their entirety. Section 22. Repeal. Chapter 5.92 MASSAGE PARLORS AND RELATED BUSINESSES, is hereby repealed in its entirety. Section 23. Amendment. Chapter 5.96.060 (EROTIC DANCE STUDIOS) is amended as follows: 5.96.060 LICENSE. The license fee of $500 is removed from this section. Section 24. Amendment. Chapter 5.96.080 (EROTIC DANCE STUDIOS) is amended as follows: 5.96.080 DANCER'S LICENSE - TERMS - RENEWAL. The license fee of $50 is removed from this section. Section 25. Repeal. Section 5.98.050 LICENSE - FEE (SHUTTLE BUS AND LIMOUSINE SERVICES), is hereby repealed in its entirety. Section 26. Amendment. Chapter 9.48.010 (FIREWORKS) is amended as follows: 9.48.010 PERMIT - REQUIRED - FEE. The license fee of $10 is removed from this section. Section 27. Amendment. Chapter 10.24.030 (OVERSIZE LOADS) is amended as follows: 10.24.030 PERMIT FEE. The license fee of $100 plus $50/mile is removed from this section.
