AN ORDINANCE vacating a portion of Marine Drive at the intersection of
Marine Drive and Kitsap Way.
WHEREAS, the owners of a tract bounded on the northeasterly and westerly
boundaries by Marine Drive and on the south by Kitsap Way, more fully described in
Section 1 hereinbelow, have initiated proceedings for vacation of the portion of Marine
Drive abutting said tract; and
WHEREAS, notice has been posted and published according to law and a public
hearing held on January 29, 1992; and
WHEREAS, the City Council finds that the portion of the right-of-way set forth
herein is not needed for future traffic circulation at'ter completion of a revision of the
Marine Drive/Kitsap intersection and should be vacated to the adjoining property owners,
now, therefore,
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Vacation. The following right-of-way is hereby vacated to the owners of
the adjoining property described below:
That portion of Right of Way lying within the following described tract of
land:
Beginning at the North 1/4 Comer of Section 15, T. 24 N., R. 1E, W.M. in
Kitsap County, Washington, Thence south l°23'50"West 2670.59 Feet to the
Center of said Section 15, Thence North l°23'50"East 139.42 Feet; Thence
North 88° 36'10" West 30.00Feet to the West margin of Morgan Road and
the True Point of Beginning, Thence north l°23'50"East along said West
margin 291.05 Feet, Thence north 88° 45'19" West, 390.00Feet to the East
margin of Bertha Ave., Thence south I°23'50'' West along the said East
margin 202.72 Feet to the Northerly margin of Marine Drive, Thence along
the Northerly margin of Marine Drive South 41°16'29"East 8.35Feet, Thence
continuing along the Northerly margin of Marine Drive South 48°43'31"West
7.70Feet, Thence South l°23'50"West along said East margin of Bertha Ave.
Extended 34.55 Feet to a point on a curve to the right having a Central Angle
of 8°28'56"and a point of radius South 65°14'35"West 390.86Feet; Thence
along said curve 57.86 Feet to a point of reverse curve having a central angle
of 25°00'00"and a point of radius North 73°43'31"East 330.86Feet, Thence
along the curve 144.36 Feet, Thence south 41°16'29"East 11.20 Feet to a
point of curvature to the left having a central angle of 86°29'42"and a point
of radius North 48°43'31"East 40.00Feet, Thence along the curve 60.38Feet
to a point on the Northerly margin of Kitsap Way, Thence along the
Northerly margin of Kitsap Way following a spiral curve a centerline distance
of 127.26 +/- to a point of change from spiral to circular curve having a
central angle of 8°16'32'' and a radius point South 31°29'02"East 1005.00
Feet, Thence continuing along said Northerly Margin 145.16Feet to the True
Point of Beginning.
Section 2. Conditions. This right-of-way vacation shall be subject to the following
conditions:
(a) the abutting owner shall provide a temporary easement for continued public
right-of-way use of the vacated portion of Marine Drive during construction
of the Marine Drive/Kitsap Way intersection, to terminate upon opening of
the new intersection for public travel, but no later than June 1, 1993;
(b) the abutting owner shall convey, by Quit Claim Deed, an unencumbered fee
interest in the property more fully described in Exhibit "A"attached hereto
and incorporated herein.
The two instruments above shall be approved as to form by the City Attorney and
delivered to the City Attorney prior to second reading of this ordinance, and filed
concurrently with the effective date of this ordinance.
Section 3. Effective Date. This ordinance shall become effective ten (10) days from
passage and publication.
