8 AN ORDTNANC~. annexing approximately 8.12 acres described as Block

10 One Plat of Bremerton Heights into the City of Bremerton and fixing
11 the effective date of annexation.

13 WHEREAS, the City of Bremerton, Washington received from five
14 property owners residing in the Bremerton Heights Neighborhood a
15 Notice of Intent to commence annexation proceeding; and
16
17 WHEREAS, an environmental review was conducted in accordance
18 with the State Environmental Policy Act (SEPA) of a portion of an
19 unincorporated County area that included the proposed Annexation
20 Area, and a Determination of Nonsignificance (DNS) was issued on
21 May 21, 1991; and
22
23 WHEREAS, proper notification having been filed with the Kitsap
24 County Boundary Review Board and approval presumed by the lapse of
25 45 days without the Boards jurisdiction invoked; gave consent to
26 proceed; and

28 WHEREAS, the City Council approved the proposed annexation on
29 May 15, 1991, subject to the assumption of existing City
30 indebtedness; and

2 WHEREAS, there was filed with the City Council of the city of
3 Bremerton a Petition for Annexation, conforming to the City
4 Council's requirements as described above, in writing and signed by
5 the owners of more than 75% in value, according to the assessed
6 valuation for general taxation, of the total property for which
7 annexation was petitioned and which is included in the Bremerton
8 Heights Annexation Area; and

-10 WHEREAS, the Bremerton City Council conducted a public hearing
11 on August 28, 1991, following proper posting and publication of
12 the hearing notice as required by law, to accepted public comments
13 on the annexation petition and accept said petition, therefore
14 NOW~EREFORE, THE CITY COUNCIL OF T~E CITY OF BREMERTON,
15 WASHINGTON DOES HEREBY ORDAIN AS FOLT~WS:
16 Section 1. The territory described in Exhibit "A" and
17 further depicted in maps as Exhibits B and C attached hereto
18 and incorporated by reference herein, said property shall be
19 and constitute a part of the City of Bremerton.
20 Section 2. In conformance with the terms of the Annexation
21 Petition, all property within the territory annexed hereby shall
22 be subject to all the City's laws and ordinances including
23 assessment or taxes in payment of any bonds issued or debts
24 contracted prior to or existing at the date of annexation.

1 Section 3. This Ordinance shall take effect ten days
2 following passage and publication.
3 A certified copy of this Ordinance shall be filled with the
4 Kitsap County Commissioners, State of Washington, as otherwise
5 provided by law.
