AN ORDINANCE creating a misdemeanor for second offense under BMC 6.32.110,
within a twenty-four period; and amending Chapter 6.32 of the Bremerton Municipal
Code.
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Amendment. Section 6.32.060 of the Bremerton Municipal Code is
amended to read as follows:
6.32.060 POSITION OF ADMINISTRATOR ESTABLISHED.
(c) Duties of the Administrator· The duties of the administrator shall include, but
are not limited to:
(1) Obtaining assistance from other appropriate city departments and officials;
(2) Training law enforcement officers and staff;
(3) Purchasing measuring instruments and training inspectors in their
calibration and use;
(4) Establishing a noise-control field procedures manual providing techniques
and procedures for measuring or reducing noise to provide for clarification, interpretation
and implementation of this chapter;
(5) Investigating citizens' noise complaint;
(6) Issuing orders for the reduction or elimination of noise ia-aeeerdam~e-
(7) "'
(-8-)- Assisting citizens and city departments in evaluating and reducing the
noise impact of their activities;
(x)-)(8) Assisting city planning officials in evaluating the noise component in
planning and zoning actions;
t~mto~ Instituting a public education program on noise; and
(-14-)(10) Reviewing at least every thre~ years the provisions of this chapter and
r~ommending revisions consistent with t~chnology to reduce nois~.
Section 2. Rel~al. Section 6.32.100 APPEAL PROCEDURE is hereby rel~ed
in its entirety.
Section 3. Amendment. Section 6.32.120 of the Bremetton Municipal Code is
amend~l to read as follows:
6.$2.120 VIOLATIONS -CIVIL PENALTY, CRIMIHAL PENALTY.
(a) Every offense defined by this chapter or conduct made unlawful hereby shall
constitute a civil infraction under the Bremerton Municipal Code; Provided, however, A
s~ond violation within a twenty-four hour l~riod shall constitute a misdemeanor.
