Parking spaces and areas shall be properly designed and readily accessible to protect the public health, safety and welfare. Section 2: GENERAL PROVISIONS A. Provision and Use of Parking Spaces. 1. Required parking spaces shall be made available and continuously maintained for the parking of operable passenger automobiles and bicycles of residents, customers, patrons and employees of the related land use and shall not be rented, leased or otherwise assigned to any person or organization without an approved joint use agreement or other City approval. 2. Development of a parking lot without a building or other structure does not require a building permit but does require site plan review in accordance with Section 5 of this Chapter and with the Site Plan Review provisions of Chapter X. C. Nonconformities. Land uses and buildings legally in existence prior to the adoption of these regulations shall not be required to comply with these provisions, except: VII-1 1. When a building is moved to a new lot, there shall be provided off-street parking and loading space as required by this Chapter; and 2. When a non-residential structure or outdoor use is increased or structurally enlarged, off-street parking shall be required for that new use; however, additional parking is not required (a) When the increase is less than ten percent of the original square footage of the space or use, or (b) When the expansion necessitates the addition of three or fewer parking spaces. When an expansion occurs in stages, the additional required parking spaces shall be provided with each stage of construction. All parking spaces required by the total project may also be included in the first stage of a multi-phase development. D. Buildinq Rehabilitation or Chanqe of Use. 1. Additional parking shall not be required as a result of a building remodel or improvement, a change in use or tenancy, or a new certificate of occupancy, provided such changes result in no significant increase in parking demand. 2. Parking Requirements for Mixed Uses. 1. For mixed use developments, the total requirements for off-street parking shall be the sum of the individual use requirements. 2. Off-street parking facilities for a specific use shall not be considered as meeting the parking needs of any other uses unless approved as a joint use parking facility in accordance with Section 8 of this Chapter. F. Roundinq of Numbers. When the unit of measurement determining the number of required parking spaces results in a fraction, any fraction of 0.5 or less shall be disregarded and a fraction greater than 0.5 shall require a full parking space. vii-2 G. Commercial Parking in Residential Zones. Off-street parking spaces, other than driveways, shall not be located within a required front setback area of any residentially zoned lot. 3. Parking spaces may be established within the front or side setback area in hardship situations if; (a) An alternative parking proposal is approved as a Variance or Administrative Variance; and (b) Such alternative parking proposal does not result in more than the minimum number of parking spaces required for the subject property or land use. 4.
