AN ORDINANCE amending the garbage and refuse abatement provisions and
amending Sections 6.04.040, 6.05.062 and 6.04.066 of the Bremerton Municipal
Code.
THE CITY OF BREMERTON DOES HEREBY ORDAIN:
Section 1. Amendment. Section 6.04.040 of the Bremerton Municipal Code is hereby
amended to read as follows:
6.04.040 ACCUMULATION AND DISPOSAL OF REFUSE.
(a) It shall be the duty of every person who owns or is in possession, charge, or in control
of any dwelling, flat, roominghouse, apartment house, hospital, school, hotel, club, restaurant,
boardinghouse, or eating place, or who owns or is in possession, charge or control of any shop, place
of business or manufacturing establishment where garbage, refuse, or swill is created or
accumulated, at all times to keep or cause to be kept portable appurtenances, metal or other
approved cans in sufficient numbers, for the deposit therein of garbage and refuse, and to deposit
or cause to be deposited the same therein~ that yard waste

are left in containers or bundled so that they will not be scattered by the wind or tipping over of
the container and can be easily picked up by the collector.
Section 2. Amendment. Section 6.04.062 of the Bremerton Municipal Code is hereby
amended to read as follows:
6.04.062 REFUSE ABATEMENT. It shall be the duty of the Building Official, whenever
there is on any property in the City any accumulation of refuse in violation of this chapter to give
notice in writing to the owner thereof or to the agent of such owner if known, and et: to the
occupant or tenant of the premises, requiring such person to remove such refuse from such property

within Seventy-two (72) hours, Provided, however, That an attempt shall be made to first give notice
to that person believed by the Building Official to have caused the accumulation of refuse. Such
notice shah contain:
(a) The name of the owner and occupant or tenant if known ......
Section 3. Amendment. Section 6.04.066 of the Bremerton Municipal Code is hereby
amended to read as follows:
6.04.066 COLLECTION OF EXPENSE BY CITY.
(a) Account of Expense. The Building Official shall keep an itemized account of expense
incurred for the removal of rubbish or garbage from a property. Upon completion of the work, the
Building Official shall prepare and file with the City Clerk, a report specifying the work done, the
itemized total cost of the work, a description of the property upon which garbage or rubbish was
removed, and the name and addresses of the owner or agent, and occupant; or tenant if known e~
(b) Report Transmitted to Council. Upon receipt of the report, the City Clerk shall present
it to Council for consideration. The Council shall fix a time, date and place for hearing the report
and any protests or objections thereto. The City Clerk shall cause notice of said hearing to be
posted upon the property involved, published once in a newspaper of general circulation in
Bremerton, and served by certified marl, postage prepaid, addressed to the owner; or agent of the
owner, and occupant o~ tenant if known or agent cf the z:vner. If the tenant or occupant is not
known, notice shall be sent by first class mail to the occupant of the residence subject to the refuse
abatement. Such notice will be given at least ten (10) days prior to the date set for hearing and
shah specify the date, hour and place when the Council will hear and pass upon the building
inspection report, together with any objections or protests which may be filed as hereinafter
provided by any person interested in or affected by the proposed charge.

Section 4. Effective Date. This ordinance shall become effective ten (10) days from passage
and publication.
